Rape, a serious crime, doesn’t trigger the Hiss Act (as amended in 1961) or any existing federal mechanisms for pension forfeiture. Congress deliberately limited those rules to national-security offenses and specific corruption crimes tied to official duties. Sexual offenses were never included. Just goes to show where Congress’s priorities are when it comes to the protections they give themselves.

If he resigns he takes all of his taxpayer funded Congressional benefits with him. Expel him.

I don’t know who needs to hear this but Democrats don’t actually care about Swalwell probably sexually abusing women the same way they didn’t actually care that Biden was a senile vegetable. Be truthful, Lauren: Under current law, Eric Swalwell keeps his FERS pension whether he resigns, or is expelled. Taxpayer-funded pension forfeiture only happens after a qualifying criminal conviction under the Hiss Act or the Honest Leadership and Open Government Act. Expulsion changes nothing financially. Conviction is the trigger. If you want expulsion to carry consequences, have Congress pass the Congressional Pension Accountability Act. Until then, this is just political rhetoric.
