Ci sono momenti nella storia di un Paese in cui il silenzio delle istituzioni pesa quasi quanto le decisioni che vengono prese. Il periodo 2020-2022 ha lasciato ferite profonde: restrizioni, obblighi, esclusioni sociali, sospensioni dal lavoro, diritti compressi, cittadini trattati come un problema da gestire più che come persone da ascoltare. E davanti a tutto questo, una domanda resta aperta: dov’era la magistratura? Perché il punto non è solo ciò che è accaduto. Il punto è anche ciò che non è stato indagato, ciò che non è stato approfondito, ciò che è rimasto ai margini nonostante denunce, richieste, documenti e testimonianze. Una magistratura davvero indipendente dovrebbe avere il coraggio di guardare anche dove è scomodo guardare. Soprattutto lì. Quando invece prevalgono inerzia, prudenza e silenzio, il rischio è che la giustizia smetta di essere presidio dei diritti e diventi spettatrice degli abusi. Il confronto con i grandi magistrati del passato non serve a fare retorica, ma a ricordare cosa dovrebbe essere la funzione giudiziaria: ricerca della verità, anche quando la verità disturba.
