The final version of my birthright citizenship article is now out @HarvardJLPP, along with articles from Keith Whittington and Gerard Magliocca. The most interesting development is the introductory essay by Judge Steven Menashi of the U.S. Court of Appeals for the Second Circuit. His essay states, among other things, "Despite what some commentators have suggested, the Supreme Court has yet to address whether the Citizenship Clause extends citizenship by birth to children of parents illegally or temporarily in the country." He also says, "We have long known that the Fourteenth Amendment does not confer birthright citizenship on the children of diplomats, foreign soldiers, or American Indians. These categories show that the status of a child follows that of the parents. But the Citizenship Clause does not reference these categories of parental status. The exclusion results from the application of a broader principle." He concludes, "the detailed consideration of the contributors to this Issue provides a solid foundation on which the debate can proceed." I think it's quite important that a Second Circuit judge recognizes the existence, nuance, and significance of the ongoing debate over these questions.
