Woodward, Jr., Associate Attorney General at the Department of Justice, announced the DOJ moved to intervene in the NAACP’s suit in Mississippi against xAI to shut down Colossus 2 (MACROHARD). This is the suit that claims xAI and subsidiary MZX Tech is violating the Clean Air Act by operating unpermitted natural gas turbines at their power facility in Southaven, Mississippi; the former Duke Energy plant. Per Woodward, “The Executive Branch—not the NAACP—is responsible for enforcing federal law. The NAACP’s lawsuit threatens American national, energy, and economic security. Tonight, the Department of Justice moved to intervene and dismiss the suit.” Per Elon Musk, “Yeah, it makes no sense. Some companies or individuals are behind this and pulling the strings.” Per James Burnham, SpaceXAI Law & Government Affairs, “This suit isn’t just wrong on the law - it would upend our constitutional structure by letting activists commandeer the federal enforcement power... The power to enforce the law belongs to the Executive Branch, not to special interest groups. This suit should fail for many reasons. The Justice Department’s powerful filing today is an exceptionally substantial one.” Of interest, there is a declaration filed by Cameron Stanley, Chief Digital and Artificial Intelligence Officer at the Department of Defense. In the declaration, Stanley states that xAI’s Grok government model supports “vital national security missions” and has been used in connection with recent U.S. military operations and was used in connection with recent U.S. military strikes against Iran.
