There is typically only one strategic reason for seeking a prosecutor’s removal: the defense believes the assigned prosecutor is highly capable and poses a significant risk of securing a conviction. From the defense perspective, replacing that prosecutor with someone less experienced or less effective could improve the defendant’s chances at trial. Conversely, if the prosecutor were perceived as weak or ineffective, the defense would be more likely to prefer that person remain on the case, since their arguments and presentation could be more easily challenged. The effort to remove the current prosecutor therefore suggests concern that the evidence and facts will be presented clearly and persuasively to the jury.
