Over 2 months ago, Hamas released a propaganda video of their terrorists holding Israeli infants. This video is still widely shared by their supporters as proof of how well Hamas treats hostages. The infants were 4.5 months old Eshel and 4-year-old Negev. What that video fails to convey is that their mother, Adi Vital-Kaploun, had just been shot dead by these same men, in front of her babies. Also unseen in the video were the children's injuries, as they had been wounded by shrapnel during the attacks. As Hamas men dragged them Gaza, Negev continually cried in pain and fear, begging the strange men to let him go. Eventually, the terrorists grew tired of the crying and decided it wasn't worth it. Hamas men simply left Eshel, Negev, and their adult neighbor Avital on the roadside to fend for themselves. Avital scooped them up and heroically managed to get them back to Israel. Back in Israel, the family would be reunited with the two little ones. Adi’s body was eventually found in her home closet, and it had been rigged with booby traps. May her memory be a blessing.

Our statement on Harvard’s refusal to remove President Gay: “Just as President Claudine Gay failed to protect her students from rampant antisemitism, the Harvard Corporation has failed to hold her accountable. Despite its begrudging and belated apologies, Harvard richly deserves the Congressional investigation to which it is currently subject, having lost all credibility on matters of antisemitism. The Corporation's decision serves only to greenlight more Jew-hatred on campus. StopAntisemitism continues to call for President Gay's resignation, and urges the Corporation to reconsider its decision and hire someone who is committed to protecting every Harvard student.”

This is an excellent summary of the serious legal and fiduciary implications to @Penn, @Harvard and @MIT of their presidents’ failed leadership, and why Gay’s and Kornbluth’s continued employment creates substantial additional risk for Harvard and MIT. In sum, by continuing to employ Gay and Kornbluth, both Harvard and MIT are continuing to endorse managements’ conduct and previous actions, deepening the universities’ liability. In a corporate context, all three would have been dismissed within minutes of an emergency meeting of the boards. For now, only Penn has acted decisively. Non-profit boards are often slow to act because they don’t have feedback from a massive stock drop and angry shareholders screaming at the directors. That said, the alumni are certainly screaming and they are shorting their donations. The proverbial stock prices of Harvard and MIT have dropped more than 50% since the October 6th close, while @Penn’s has bounced 20% off the lows based on today’s news, but is still down 40%. Penn’s recovery will depend on whether and how its board is refreshed, who they choose as their next president, and whether they make necessary fundamental changes to the institution. The same holds true for the others.

President Gay has become a major liability for Harvard University: **🎥Shocking Video of President Gay’s Testimony to Congress on Tuesday, December 5’th below.** 1) If her inflammatory and Antisemitic statements continue Harvard will likely be charged under the Civil Rights Act of 1964 Title VI clarified to explicitly include Antisemitism by the Biden Administration on September 26, 2023. 2) Harvard and other endowments may lose special tax exempt status. Treasury may argue that by taking a specific political position against Jewish Americans, a position that would not be taken against other ethnic groups, Harvard is politicizing itself and thus subject to ordinary tax treatment. This would be disastrous to Harvard University and Harvard Corporation and this could involuntarily drag along other endowments into a taxable status. 3) Donors, both Jewish and the 90% of alumni who do not share Antisemitic views will vote with their feet and as much as a predicted 60-90% of future donations may be lost from the alumni base. Non-Jewish alumni will be reluctant to step into the political crossfires by supporting an institution that explicitly condones and protects genocidal statements (shockingly in President Gay's own words). The vast majority (97% of donations) are made on a non-anonymous basis in order to build legacy at Harvard and with 1000's of causes competing with Harvard - donors will be reluctant to donate and be labeled bigoted and complicit in genocidal rhetoric through a historic lens. The Harvard Corporation has a Fiduciary duty to both the University and its alumni base to: 1) Remove President Gay effective immediately. 2) Take immediate action and expel students who are threatening and intimidating Jewish students with genocidial statements (no more teethless PR statements). 3) Outline specific policies that puts Harvard back into compliance to the Civil Rights Act of 1964 Title VI and takes away the risk of litigation, loss of federal funding, and loss of tax exempt status. Action must be taken TODAY in order to turn around the disastrous mismanagement of Harvard University, Harvard Corporation, and the Harvard Brand by President Gay an institution President Gay inherited with a nearly 400 year track record and brand. Harvard alumni can no longer sit on the sidelines and hope that President Gay “pivots from Antisemitism”. We are asked at convocation to show class unity and to stand with our classmates. Today, Jewish Students and Alumni ask that ALL Harvad Alumni, Jewish, Arab, and Gentile, Straight or LGBTQ+, Black, Brown, White, Hispanic, stand with US and reject Genocide and its defenders.
