It's an interesting thought: suppose in 1941 a Japanese sneak attack wipes out Congress. Would Roosevelt really be unable to wage war because there's no Congress left to declare war? Seems obvious the answer is no. That, however, doesn't then mean what Trump is doing is Constitutional.
