If you are trying to justify the move without Congress, it's not going to work.
The framers gave the President power only 'to repel sudden attacks' (Madison's notes, Aug 17, 1787)—defensive response to actual/imminent assaults, not preemptive first strikes against potential future threats. 'Repel' ≠ 'attack before being attacked.' Congress declares/initiate wars; Exec repels the sudden ones. Original intent matters.
