Kisumu County Governor Prof. Anyang’ Nyong’o has condemned what he terms unlawful use of state power in the ongoing property dispute involving former Cabinet Secretary Raphael Tuju, warning that the deployment of police officers in a civil matter undermines Kenya’s democratic principles.
In a strongly worded statement on Sunday, Nyong’o questioned the legality of using uniformed police officers to enforce actions in a commercial dispute, describing the move as a troubling abuse of authority.
The Governor explained that debt recovery and commercial disputes fall squarely within the realm of civil law and should be handled through transparent and lawful procedures.
He described the raiding of Tuju's Karen property as “nocturnal operations and coercive displays of state power” in a matter that should be resolved through the courts.
"The use of uniformed police officers whose primary duty is to maintain law and order to facilitate actions that seemingly bypass established legal processes is troubling. Debt recovery and commercial disputes are clearly addressed within the framework of civil law, and such matters ought to be handled transparently and through lawful procedures," Nyong'o said.
Nyong’o further condemned the move as humiliation of a former senior public servant, reminding Kenyans that Tuju had served the nation at the highest levels of leadership.
The Kisumu governor warns that the misuse of state power in civil matters could erode investor confidence and damage the country’s international reputation.
Tuju was forcibly removed from his Karen property by armed police on Saturday. The property has been at the centre of a long-running dispute between the former CS and a bank that auctioned it after an alleged 2015 loan default.
The incident followed a letter from Tuju to Chief Justice Martha Koome, in which he accused certain elements within the Judiciary of corruption and colluding with some powerful individuals to take over his property.

The late Raila Odinga, throughout his political life, never hesitated to call out state excesses, even when politically allied with those in power. However, Oburu has chosen the path of silent complicity.
His reluctance to speak up amidst Raphael Tuju's woes raises serious questions about his courage to face President Ruto, and his unbiased commitment to justice for all.
Unknown to many Kenyans, it was the late Raila Odinga who, while in a working pact with the UDA administration, compelled the Ruto government to halt the abduction of citizens and vocal online critics.
Raila never minced his words when he felt his partner, the President, was veering off course. Odinga's moral authority and political weight in ODM forced William Ruto to toe the line, out of respect and fear of upsetting a principled ally who took no prisoners when he felt the people were oppressed.
Whether in government or opposition, he stood for the rule of law, constitutionalism, and justice for all.
The recent police raid on former Rarieda MP Raphael Tuju’s Dari Business Park in Karen shows how far the country has drifted from Raila's ideals. In the dead of night, more than 50 officers stormed the property, forcing out workers and guests alike.
The raid, linked to a long-standing dispute between Tuju and the East African Development Bank over a 2015 loan, has raised questions on the heavy use of police and armed goons in what appears to be a civil matter.
Tuju has maintained that the issue goes beyond a simple loan default, alleging that powerful individuals are targeting his businesses.
The manner in which the raid was conducted, under the cover of darkness, with unmarked vehicles and heavy police presence, reeks of intimidation and abuse of power.
If Raila Odinga were alive today, he would have demanded due process. He would have reminded the government that Kenya is not a gangster republic, and that the rule of law must prevail over brute force. His voice would have echoed in defense of fairness, not silence in the face of abuse.
Where, then, is Oburu Oginga? His voice is conspicuously absent at a time when it is needed most. Calling out police lawlessness is not an attack on President Ruto.
It is not a betrayal of the ODM–UDA pact, but a defense of the very principles that his late brother lived and would put his life on the line for.

Latest reports indicate that Kalonzo Musyoka's Wiper Party could face deregistration from Kenya's official register of national political parties for failing to meet the constitutional requirement for national inclusivity.
This means Wiper may no longer be recognized as a legitimate party unless it quickly demonstrates nationwide support beyond Ukambani, an obstacle making Kalonzo’s 2027 presidential bid far less viable.
Amid this uncertainty, Rigathi Gachagua has been actively advocating for the former VP's presidency. On the surface, this appears supportive, but when combined with the party’s weak national structure, it raises questions.
Could it be that Gachagua’s backing of Kalonzo is strategic, by positioning a presidential candidate who is unlikely to succeed in 2027, thereby indirectly benefiting President William Ruto for a smoother second-term ?
Meanwhile, Gachagua is also involved in promoting his own party, the Democracy for Citizens Party (DCP).
Under Cleophas Malala and Hezron Obaga, DCP is being prepared as a strong political brand, arguably to be popularized by Gachagua before it is eventually handed over to Ruto by April 2027.
At the same time, the Jubilee Party, Kenya’s only structured party with national appeal and wide reach, is reportedly imploding from the inside. Its DCP partner in the United Opposition and leader Gachagua is making it harder for Jubilee to remain a viable political force.
With a dismembered Jubilee Party, and the faltering of smaller parties like Wiper by 2027, there may be no major opposition party standing, leaving Ruto with minimal competition, considering he has struck a working pact with Oburu Oginga's ODM.
It is fair to ask whether Ruto is using Gachagua’s actions, both with Kalonzo and other parties, to engineer an easier path to victory in 2027.

Ghanaian President John Dramani Mahama is pushing for a new international proposal seeking formal global recognition of the transatlantic slave trade and its role in history.
Describing the initiative as grounded in international law, Mahama said it aims to ensure that the world formally acknowledges the scale and impact of one of history’s darkest chapters.
Speaking on the sidelines of the African Union (AU) summit in Addis Ababa, Mahama said the move is a crucial first step to ensuring that the truth about the transatlantic slave trade is globally recognised.
“This is about truth, justice, and historical accountability,” he said, emphasizing the importance of collective acknowledgment by the international community.
According to Ghanaian officials, the proposal has already received unanimous backing from all 40 African member states, including Kenya, within the AU. The resolution is expected to be tabled for a vote later this month.
Earlier this week, Ghana’s Foreign Affairs Minister Samuel Okudzeto Ablakwa appealed to members of the Commonwealth of Nations to support the initiative.
Addressing the 26th Commonwealth Foreign Affairs Ministers Meeting in London, Ablakwa urged fellow member states to rally behind the proposal ahead of a vote anticipated around March 25.
Ablakwa said the resolution seeks to secure formal global recognition of the scale, brutality, and long-term consequences of the centuries-long trade in enslaved Africans. He added that the measure would also strengthen ongoing global conversations about reparative justice and historical redress.
Calls for reparations linked to slavery and colonial exploitation have gained renewed momentum in recent years. Governments across Africa and the Caribbean have increasingly argued that the legacy of slavery continues to shape economic inequalities and social injustices today.
The transatlantic slave trade, which spanned from the 15th to the 19th century, saw more than 12 million Africans forcibly transported to the Americas.
Historians note that the trade devastated African societies while generating immense wealth in Europe and the Americas.

Botswana’s President Duma Boko has turned down an invitation from U.S. President Donald Trump to visit the White House, insisting that any official discussions concerning Botswana’s natural resources must take place within the country’s borders.
President Boko says Botswana would no longer travel abroad to negotiate matters tied to its own assets and future, asserting that genuine partnerships should be built on mutual respect and equitable engagement.
“If there is genuine interest in what Botswana has to offer, partners should come to Botswana to engage directly,” the Harvard-trained lawyer who recently ended Botswana's nearly 60-year run of one-party rule said.
“In business, buyers go to the sellers. When that principle is ignored, the seriousness of the interest must be questioned.”
The decision marks a notable stance in African diplomacy, reflecting a growing sentiment among some African leaders to redefine how international negotiations are conducted.
Analysts across the continent view Boko’s move as a statement on sovereignty showing how African nations are increasingly asserting control over the terms of engagement with global powers.
