Okay that’s fair enough but I literally never once said the first comment was anything the police would investigate so I don’t know what point there is to be made there. My initial comment expressed my indifference towards one shitty person being threatened by another shitty person, it had absolutely nothing to do with legality whatsoever.

But my actual point is that the first comment doesn't even warrant an investigation and wouldn't be a cause for one. The second one unquestionably does, even if nothing comes from it. That's the difference.

@VelcroShoeLaces @ontheflipsiide The initial argument you made was about this being "legally actionable" and if investigators don't find any actions or a person's identity associated with a social media account to investigate, there's not much of anything legally actionable for them to work with.

The second comment, even if never acted upon, is still investigation worthy. Doesn't matter if they don't find anything.

The second one would *easily* be investigated due to the level of specifics involved; buying a gun, choosing a location, picking targets, enjoying doing it.

@VelcroShoeLaces @ontheflipsiide Considering that legality of abortion varies from state to state, a comment about aborting all male children could very well be investigated, depending on the state the poster lives in, so both could be flagged for an investigation and potentially dismissed for various reasons.

Well I never at any point said the first comment was legally actionable or any violation of the law... As far as the second one being legally actionable; that depends on what you mean and would largely be contingent on a variety of other factors. If the person was investigated and showed no other signs of potential violence besides online posts, no weapon ownership, no prior violent history, no one L/E talks to claims they're physically violent or make these types of threats in person, the likelihood of being arrested of being arrested solely for online posts/messages is very low.
