The European Commission has proposed extending the temporary “Chat Control 1.0” rules by two years, from 3 April 2026 to 3 April 2028. These rules allow online service providers to voluntarily scan private messages, images and videos for known child sexual abuse material using automated tools. No court order or individual suspicion is required. The scanning mainly occurs on non-encrypted services. EU governments (the Council) approved the extension on 30 January 2026. The European Parliament has not yet taken a position. The proposal requires approval from both Parliament and Council to become law. A final agreement is expected around mid-2026. In the permanent rules, the Council has removed any mandatory scanning of private or encrypted communications. Instead, the focus is on risk assessments, prevention measures, reporting obligations and strong protection for end-to-end encryption. The two-year extension would keep voluntary scanning permitted in the meantime.
