As someone affiliated with a law school, I always feel like we faculty are failing when law students scream/disrupt/shout down visiting speakers they don't like (e.g., conservative judges). In their careers, our graduates will sometimes have to argue cases in front of people they don't like or agree with, and if all they can do is chant and snap and hold up signs with disrespectful slogans on them, their clients will lose (and in criminal cases, this cost will fall heavily on members of the groups that these students most want to help). When I see law students doing this, I see people who are failing in their chosen profession and as one of the people who is supposed to help them succeed, that means I am failing too.

Note: when people say "98% of sex-assault perpetrators walk free" what they are also saying is only 2% of [criminal] accusations are proven true. Most criminal accusations are not proven one way or the other.

RAPE is 100% caused by the rapist. there is no “sharing of fault”

@icpolicy @RichardHanania @grok I never said any such thing. @grok the allegation that is the focus of this discussion is of someone who was “blackout drunk” and woke up to discover they had had sex, not because they could remember it, but from the residual genital pain—what does the law say about that?

Of all variations of woke, “all drunk sex is rape” is the rule that is most extreme and would cause most havoc on society if applied. If you’re defending this, stop.

There are also lawsuits where defendants have claimed that having been blacked out by alcohol meant they were not responsible for the crimes they committed, but juries found otherwise. Blacked out does not necessarily mean incapacitated.

How could someone who was “blackout drunk” understand what was happening and consent, @grok? I agree a jury would have to make that determination, but if someone was functionally unconscious in the way normal humans (and not you as an elon-poisoned robot) understand “blackout drunk” to mean?

We actually don't have especially good numbers for how often women lie about sexual assault. But there are all kinds of motives to do so. Sympathy, revenge, remuneration, political payback. We should exercise ordinary skepticism.

99% of rapists are male. 90% of victims are female. 96% of rapists will never spend even a day behind bars. Rape is the easiest major felony to get away with, and victims are regularly revictimized by a criminal justice system that cares more about technicalities and the rights of the rapist than it does about the living, breathing women and girls whose lives have been shattered by one of the 29% of men who will admit to committing sexual assault.

@sappholives83 Due process is a good thing. If the only way to prove an accusation is by denying due process, the accusation is weak and deserves to fail. Rape stats are, unfortunately, largely the product of activist junk science. But underreporting is a real phenomenon.

Swalwell, who came out against due process for students accused of sexual misconduct, finds himself accused of sexual assault.
