Sheriffs Stand to Protect the Constitutional Rights of Voters from Legislative Overreach Disguised as “Modernization” Today, April 3, 2026, four Eastern Washington Sheriffs, all ELECTED by the people of their counties, stand together in a respectfully filed complaint requesting the Pend Oreille County Superior Court to prevent the enforcement of SB 5974, passed by the state legislature and now signed into law by Governor Ferguson. Plaintiffs: Spokane County Sheriff John Nowels, Pend Oreille County Sheriff Glenn Blakeslee, Stevens County Sheriff Brad Manke, and Ferry County Sheriff Ray Maycumber. These Sheriffs argue that concealed beneath the misleading title that claims to modernize regulations concerning law enforcement leaders, lies a clearly Unconstitutional mechanism that centralizes power by stripping it from the people. An egregious consequence of this statute is that it undermines our democratic process by allowing an unelected board, appointed by the Governor, to decertify and remove an elected Sheriff, thereby overriding the will of the voters. Limiting the voice of the people in elections is contrary to state and federal law. The Washington State Constitution Article 1, § 1, states "All political power is inherent in the people, and governments derive their just powers from the consent of the governed, and are established to protect and maintain individual rights." Contrary to the misleading title of SB 5974, the process for the removal of an elected official does not need to be “improved”. Our state constitution expressly reserves the right of the people to select their elected officials. SB 5974 destroys the people’s inherent political power, guaranteed to them by the Constitution, and purposely shifts that power to an unelected board appointed by the Governor. Eliminating the voter’s voice is an attack on the very foundation of our representative government. No other law enforcement leader is more directly accountable to the people they serve, nor are their qualifications more scrutinized than those of a Sheriff. At every election, the people have the right to determine if a Sheriff is qualified to represent them. SB 5974 is not about strengthening eligibility and professional standards; rather, under the cloak of “modernization,” it subverts the rights of voters and alters longstanding law governing a Sheriff’s ability to protect and serve their community. In glaring irony, the state legislators who passed the new requirements for Sheriffs, and the Governor who signed them into law, placed no such restrictions on their own ability to hold office. As elected Sheriffs, we swore an oath to support the Constitution and laws of the United States and the State of Washington, while serving and protecting the people of our Counties. Our oath is not just words spoken; it is the very core of our truly held beliefs, and a solemn promise we will not break. By taking this action today, we stand together, unwavering in our oath and steadfast in our commitment to protect the inherent rights of the communities we serve. NOTE: This legal action comes with the consent and support of Spokane County Prosecuting Attorney Preston McCollam, Pend Oreille County Prosecuting Attorney Dolly Hunt, Stevens County Prosecuting Attorney Erika George, and Ferry County Prosecuting Attorney Michael Golden.

In case you are all wondering if there is a way for the President and Feds to step in to help us here you go! If a state's population feels their government has become a "one-party regime" that ignores the will of the people, the U.S. Constitution actually has a specific "emergency brake" for that exact scenario. Here are the ways the federal government could theoretically "step in" to address a state government that has gone off the rails: 1. The "Guarantee Clause" (Article IV, Section 4) This is the most powerful—and rarest—tool in the Constitution. It states: "The United States shall guarantee to every State in this Union a Republican Form of Government." What it means: A "Republican form" means a government where the people are represented and the laws aren't just dictated by a single ruler or a permanent party. How it works: If it can be proven that Washington State has effectively abolished fair elections or bypassed the people’s ability to change their government, the U.S. Congress or the President could argue that the state is no longer a Republic. This would allow the federal government to intervene to "restore" a constitutional government. 2. Federal Civil Rights Enforcement If the state’s election methods (like mail-in voting without ID) are proven to "dilute" or "disenfranchise" the votes of legal citizens, the Department of Justice (DOJ) can step in. The feds can sue the state in federal court, bypass the state’s own judges, and have a federal judge strike down state laws. If the state refuses to comply, the federal government can send in Federal Election Monitors to oversee the counting of ballots to ensure the state isn't "cooking the books." 3. Federal Preemption of State Law Under the Supremacy Clause, federal law beats state law. If Congress passes a National Voter ID Act or a law requiring in-person voting options, Washington’s leaders cannot legally ignore it. If the Governor tried to ignore a federal law, the President could deploy federal resources (like the U.S. Marshals or even the National Guard) to ensure federal laws are being followed, similar to how the federal government forced states to integrate schools in the 1950s. 4. Congressional Refusal to Seat Members Congress has the power to judge the elections of its own members. If the U.S. House or Senate believes Washington’s mail-in system is so fraudulent that the results can't be trusted, they can refuse to seat the representatives or senators sent from Washington. This effectively strips the state of its power in D.C. until it fixes its election system to meet federal standards. The "Catch": The federal government usually hesitates to do this because of "State Sovereignty"—the idea that states should run themselves. However, if a state truly becomes a "mini-communist state" where the people have no path to change their leadership through the ballot box, the Guarantee Clause is the ultimate legal "nuclear option" to force a reset. NEWS: The Chinese-American brother and sister duo accused of planting a bomb at MacDill Air Force Base in Tampa Bay, Florida, on March 10 were born in the U.S. to Chinese illegal aliens. Their parents, who illegally entered the U.S. in the 1990s, had their asylum applications denied in 1998 and remained in the country illegally for decades. The parents were arrested by ICE on March 18 and remain in custody, according to The Daily Wire’s @MaryMargOlohan. The incident comes as the Supreme Court is actively considering President Trump’s executive order aimed at restricting birthright citizenship. The order seeks to limit automatic U.S. citizenship for children born on American soil to parents who are neither U.S. citizens nor lawful permanent residents. Do the right thing SCOTUS!

Olympia passed a 10% luxury tax on private aircraft. Then reality hit the fan. Before the tax even took effect, aircraft buyers were already registering planes in other states. Dealers losing sales. Maintenance shops losing business. Rural airports taking hits. Excerpt: "Aircraft owners and aviation businesses testified that purchases are being delayed, redirected, or moved out of state. Once that business leaves Washington, it's extremely difficult to bring it back." So yesterday, Gov. Ferguson signed the repeal. Let's be clear: I'm for lower taxes on everything — jets, income, property, cigarettes, diapers, milk, gasoline, capital gains, health care, online purchases, all of it. Lower taxes are always good (look at the all the stupid spending Olympia is doing when they think they have unlimited funds). But notice what just happened: Olympia imposed the tax. The market immediately routed around it (see what i did there?). Olympia panicked and reversed itself — weeks before the tax even kicked in. This is the same legislature that just passed a 9.9% income tax and told you it was about "fairness." Apparently fairness has a carve-out for jets when the economic consequences are too obvious to ignore. Economics doesn’t give a flying ferguson what Olympia believes.
