Inbox: Athlete advocacy group Athletes.org has released a proposal for a CBA for college sports (where athletes aren't employees). The concept of a CBA would provide stability/end flood of lawsuits, but has always been controversial. Appears it is gaining steam.

“Is there a way for students to collectively bargain and not become employees? … It’s incumbent upon all of us in the industry to examine this.” - Bubba Cunningham, who @YahooSports featured in a deep dive in June on collective bargaining & college sports yhoo.it/46juPIG

AO announces that its leaders presented to 24 power conference general managers on Sunday in Nashville their plan for collective bargaining - a similar presentation they’ve socialized with coaches & ADs. All GMs support a version of a CBA in college football, AO says.

Congress has been strongly urged by pro sports unions to reconsider antitrust exemptions for colleges. Granting these exemptions would be a major step backward, letting the NCAA return to its outdated ways of controlling and limiting athletes’ opportunities. After decades of benefiting from rules that blocked athletes from earning fair compensation, the NCAA, schools, and institutions don’t deserve another shield from oversight. It's time to move forward, not regress to policies that hurt college athletes.

Jim Cavale’s recent op-ed in The Chronicle of Higher Education highlights a critical issue: the need for college athletes to have true representation and a meaningful voice in shaping the future of collegiate sports. As Cavale eloquently states, "The right to representation is as American as apple pie." In his piece, Cavale, Chairman and Co-founder of Athletes.org, emphasizes the importance of empowering athletes to organize, negotiate, and advocate for their rights in an evolving sports landscape. With college athletics undergoing transformative changes—such as NIL agreements and pending decisions around revenue sharing—Cavale argues that athletes must have a seat at the table to ensure fair treatment and equitable opportunities. Check out key takeaways from Cavale’s op-ed and learn why representation isn’t just a privilege—it’s a necessity for the future of college sports. @chronicle @jimcavale

The first concern she is addressing is the lack of representation for future college athletes. Her second concern is with the rules that would limit NIL deals with collective and boosters. She seems to question whether there’s a procompetitive justification for those rules.

Judge Wilken opened the hearing by saying she will not be ruling from the bench. So there won’t be a decision today. She did say she’ll provide some commentary on her views on certain parts of the settlement, so parties can address them. Which she is doing now.
