أصدر معالي عبدالله سلطان بن عوّاد النعيمي، وزير العدل، رئيس مجلس القضاء الاتحادي، ، قراراً بشأن تنظيم محكمة الإفلاس، في خطوة تهدف إلى تطوير البنية القضائية الداعمة للاقتصاد الوطني، وتعزيز فعالية منظومة العدالة في التعامل مع حالات التعثر المالي والإفلاس. ونص القرار على أن محكمة الإفلاس تتخذ مقراً لها في محكمة أبوظبي الاتحادية الابتدائية، وتتولى الفصل في جميع الطلبات والمنازعات الناشئة عن تطبيق أحكام المرسوم بقانون الاتحادي بشأن إعادة التنظيم المالي والإفلاس. كما أجاز القرار لمجلس القضاء الاتحادي، عند الاقتضاء، إنشاء مقر أو أكثر للمحكمة في أي من إمارات الدولة تتبع المحكمة الأصلية، ويختص بذات الطلبات والمنازعات. وتتكون المحكمة من رئيس لا تقل درجته عن قاضي استئناف، وعدد من القضاة المختصين تتم تسميتهم بقرار من مجلس القضاء الاتحادي. وتضمن القرار إنشاء إدارة للإفلاس ضمن المحكمة برئاسة قاضٍ لا تقل درجته عن قاضي استئناف، تتولى مجموعة من المهام، أبرزها تلقي الطلبات والاعتراضات والتظلمات وقيد الطلبات وتوجيه الإخطارات لذوي الشأن وفقاً لأحكام المرسوم بقانون، بالإضافة إلى التحقق من استيفاء طلبات التسوية الوقائية، وإعادة الهيكلة، والإشهار للبيانات والمستندات المطلوبة. وحدد القرار الوحدات الإدارية التابعة للمحكمة واختصاصاتها، بما يضمن تكامل الأدوار وفعالية الأداء. وشمل القرار كذلك أحكاماً خاصة بخبراء ومستشاري الإفلاس، حيث أجاز للمحكمة الاستعانة بذوي الخبرة والتخصص في هذا المجال، للقيام بمهام عدّة منها إدارة أموال المدين وأعماله، وتنفيذ التدابير التحفظية، وتسريع الإجراءات، والاجتماع بالدائنين، والاستماع إلى المدين أو من ينوب عنه في المسائل المتعلقة بديونه أو أمواله أو أعماله. ويُعد هذا القرار خطوة نوعية نحو ترسيخ بيئة قانونية داعمة للاستقرار المالي تسهم في تسريع الإجراءات وتحقيق التوازن بين متطلبات العدالة وضمان استمرارية النشاط الاقتصادي وفق أعلى معايير الكفاءة والشفافية. #مجلس_القضاء_الاتحادي
