Please educate me and enlighten me about this. @imigrasimalang regularly uses idols’ images as the main hook for its content, mostly featuring Seventeen, with the stated purpose of education. At first, as someone who was unfamiliar with the issue, I thought it was acceptable, because educational content that uses idol images can attract a wider audience and help raise public awareness about existing knowledge. However, it later became known that this account uploads content using AI-generated images, moreover, using photos from their childhood and being used by an account that represents a government-affiliated implementing body. So, it made me questioning something. After looking further into the legal basis related to copyright, I found the following: LAW OF THE REPUBLIC OF INDONESIA NUMBER 28 OF 2014 ON COPYRIGHTS. CHAPTER II COPYRIGHTS, Part Three Economic Rights, Paragraph 2 Economic Rights to a Portrait. Article 12: Every Person is prohibited from engaging in Commercial Use, Reproduction, Publication, Distribution and/or Communication of a Portrait taken for commercial billboards or advertising purposes without the written consent of the persons in the portrait or their heirs. Article 13: The Publication, Distribution, or Communication of the Portrait of a Performer or several Performers in a public performance are not regarded as an infringement of Copyright, unless stated otherwise or authorized by the Performers or holders of the right to the performance prior to or during the performance. As far as I know, an educational campaign run by an institution (especially a government body) that uses idol images as a visual hook can reasonably be classified as commercial or institutional use, even if it is not monetized and the use of AI-generated images and childhood photos of real individuals is a major legal and ethical red flag, especially for public-sector actors. The question: 1. Is the use of idol images and the use of AI-generated images based on an idol’s childhood photos for a campaign run by an official government institution legally permissible and morally acceptable? I am not seeking a debate, but rather clarification and appropriate follow-up regarding this matter, @imigrasimalang. Thank you.
