The disclosure sequence here is what courts care about. DOGE gets access to Social Security data. Court blocks it. Supreme Court allows it to resume. Then DOJ admits it gave the court incorrect information during those proceedings. Then discloses: unauthorized server used for the data, and a secret agreement with a political group to analyze voter data tied to overturning election results. The conduct was happening while the court was deciding whether to allow the conduct. The incorrect information was provided while the court was making that decision. The Fourth Circuit sent it back down for a fresh look with the newly disclosed facts included. It flagged "even more alarming" developments it didn't detail. The case now goes to discovery - meaning the full scope of the agreement, who the political group was, and what they did with the data, will be subject to legal compulsion. Social Security numbers. Medical records. Financial records. Millions of Americans. A secret political operation. Courts told something incorrect during the proceedings. The Fourth Circuit called it alarming. It said so twice.

Your medical debt is ILLEGAL on your credit report in 15 states The bureaus are still reporting it. 100 million Americans have medical debt. The bureaus make money selling your data to lenders, insurers, and employers so they keep reporting shit they're no longer legally allowed to report Until you send one letter. Then it's deleted in 30 days The 15 states where medical collections CANNOT appear on your credit report: California Colorado Connecticut Delaware Illinois Maine Maryland Minnesota New Jersey New York Oregon Rhode Island Vermont Virginia Washington If you live in any of these states and have a medical collection sitting on your credit report right now, that item is being reported in violation of your state's consumer protection law The bureaus know this. They changed nothing until someone forces them to The letter: "To whom it may concern: I am writing to dispute the following medical collection account currently reported on my credit file: [account name, account number, balance] I am a resident of [state]. Under [cite your state statute], the reporting of medical debt on consumer credit reports is prohibited. This account is a medical debt and its continued presence on my report violates state law I demand immediate removal within 30 days. Failure to comply will result in a formal complaint to my state attorney general's office and the CFPB, as well as consultation with a consumer rights attorney regarding statutory damages [Name, address, last 4 SSN, DOB]" Send certified mail, return receipt requested, to all three bureaus: Equifax: P.O. Box 740256, Atlanta, GA 30374 Experian: P.O. Box 4500, Allen, TX 75013 TransUnion: P.O. Box 2000, Chester, PA 19016 Now even if you DON'T live in one of these 15 states, the bureaus themselves changed the rules in 2023: Paid medical collections? Can't be reported anymore. Nationwide. If you paid a medical bill and it's still showing as a collection on your report, that shouldn't be there Medical collections under $500? Can't be reported regardless of payment status. Doesn't matter what state you're in New medical collections? Can't appear until at least 365 days after the original delinquency date. If something showed up before that window closed, it's reportable as inaccurate under FCRA Section 611 Same letter. Different legal basis A woman came to us with 7 medical collections totaling $34,000 across all three bureaus. Lives in Colorado. Every single one was being reported illegally We sent 21 letters. 7 accounts × 3 bureaus. 19 items deleted within 30 days. The last 2 deleted after CFPB complaints $34,000 in medical collections. Cost her $0 to fix. Postage and 30 days Score: 512 to 697. She bought a house 4 months later after being denied 3 times The bureaus are billion-dollar companies. They know the law changed. They're betting you don't They'll keep reporting illegal data on your file until you make it more expensive to keep it than to delete it That letter makes it expensive (I delete medical debt and every other type of collection off your credit report in 30-90 days. Application fee: $205 Here's the exact formula they use to decide your number and how to make sure yours gets accepted The IRS doesn't want to chase you for 10 years. Collection costs money. Agents cost money. Liens cost money. They'd rather take $5,000 today than spend $50,000 over a decade trying to squeeze $100,000 out of someone who will never have it That's the entire program. They did the math and built a form for it The formula: The IRS calculates your "Reasonable Collection Potential." What they realistically think they can get from you. Your offer needs to meet or beat that number RCP = (monthly disposable income × remaining collection months) + (asset equity after exemptions) Monthly disposable income: your gross income minus IRS-allowed expenses. They have specific tables for housing, food, transportation, and healthcare by county. Not YOUR expenses. THEIR approved numbers If you earn $4,000/month and their table says your allowable expenses are $3,800, your disposable income is $200/month Remaining months: for a lump sum offer (paid within 5 months), they multiply by 12. For a payment plan (6-24 months), they multiply by 24 Assets: bank accounts, investments, vehicles, property. But they subtract exemptions. Your primary car up to a certain value is exempt. Household furnishings exempt. Retirement accounts often partially exempt Real case: Disposable income: $200/month Asset equity after exemptions: $2,000 Lump sum RCP: ($200 × 12) + $2,000 = $4,400 That's your offer. $4,400 on $100,000 in tax debt. 4.4 cents on the dollar The forms: Form 433-A (OIC): full financial disclosure. Income, expenses, assets, bank statements. Every number. Fill it out honestly because they verify everything. Lying on this form is a federal crime and they'll reject your offer AND flag you for audit Form 656: the offer itself. Your amount. Your payment terms $205 application fee (waived if income is below 250% of federal poverty level) Initial payment: 20% of your offer submitted with the application for lump sum. On a $4,400 offer that's $880 upfront Here's the part that makes this genuinely broken: While your offer is being reviewed, which takes 6-24 months, ALL collection activity stops. No levies. No liens. No wage garnishment. They legally cannot collect while the OIC is pending And if the IRS doesn't make a determination within 2 years of receiving your application? Your offer is automatically accepted. Two years of silence = you win by default. That's in the tax code lmao Client owed $147,000 across 3 tax years. Hadn't filed. Hadn't paid. Getting letters every month. We calculated his RCP at $6,200. Submitted the OIC with $1,240 initial payment IRS accepted 7 months later $145,000 in tax debt settled for $6,200. 4.2 cents on the dollar He went from not opening his mailbox to a $0 IRS balance. Then we fixed his credit. Then we stacked $80K in 0% business funding. Started a pressure washing company 5 months later The IRS is the scariest creditor in America. They can garnish without a court order. Seize your bank account with no warning.
