This is the kind of sheer stupidity that actually has a useful side effect. When someone is so detached from basic reasoning, it forces everyone else on the Court to draw a bright line around what not to do and makes it harder for Roberts, Kavanaugh, Barrett, or even the two other liberals, to drift in that direction. In that sense, having someone like Jackson on the Court is helpful. But that only works if she remains an outlier. One or two voices like that can have a corrective effect. The problem is scale. Add a few more such appointments via autopen and the mechanism doesn’t just break down, it runs in the opposite direction. Instead of a corrective effect, you get a catastrophic feedback loop of stupidity, where stupidity validates itself, each opinion lowering the bar for the next, until rank asininity becomes the standard.

Great nations would never allow their enemies to illegally invade, drop a couple million babies, and them immediately declare that the enemy’s progeny magically have the exact same rights as the soldiers fighting to protect the homeland. That is not something a great nation would ever do. The acceptance of the Trojan horse offering from the Greeks is viewed as the perfect emblem of how a nation can be doomed by its own strategic ineptitude. But recall that the Trojans were tricked by the Greeks. Of course Troy never would have allowed the Greeks to enter the city had they know the gift’s true nature. Only a laughable nation full of morons destined to be a footnote of history would have intentionally invited its enemy inside to destroy it from within. Yet that is exactly what Chief Justice John Roberts argued by implication today during oral arguments over birthright citizenship. Roberts suggested that America—the greatest nation in history—enacted a law (which its own authors say did not apply to foreigners or aliens) effectively telling the Greeks they didn’t even need to go to the trouble of building fake horses. All they had to do to eventually outnumber and conquer Troy was make sure enough Greek woman had their babies inside the city’s walls. Why defeat a nation militarily when you can just slip across its borders, birth an army that magically has the power to determine who runs your enemy’s government, and take over the whole thing without firing a shot in anger? A great nation would never be so stupid as to do such a thing. And America never did. The 14th amendment’s text makes it clear. The statements of its author at the time make it clear. The legislative and judicial history at the time make it clear. A great court would never sentence a great nation to its own demise by declaring that an enemy can unilaterally make its own children full citizens of its foe simply by invading and bearing children there. And a great chief justice of a great court of a great nation would never allow such an absurdity to rule that nation.

How is this even a serious conversation? The idea that ANYONE can fly from ANYWHERE into America, have a baby, then fly back with citizenship is unserious. And yet, that’s exactly what is happening. Birthright citizenship should be rejected by SCOTUS immediately.

As many are beginning to understand after listening to oral arguments today, the Supreme Court does not exclusively weigh the law, the facts, the text, and the history to come to its conclusions. Sometimes it does that. But in the most political and contentious cases, that is most definitely not what happens. We do not actually have a supreme court, we have a lifelong legislature of lawyers who prefer the robe to the campaign trial. One-third of the court makes decisions based entirely on what is best for the Democrat party and never wavers from that mission. Only two of the nine justices seem to have any consistent interest in determining a given law’s text and original meaning. Of the remaining four, the chief justice thinks he’s a thermometer whose job is take to the temperature of the country and then make decisions based on whether they’ll make people like him. The former professor seems to think she’s still writing academic papers. The former Western judge is occasionally reliable when he’s not claiming boys can become girls or fan-girling over Indian treaties. The final justice seems to be saddled with the horrifying task of corralling the two rudderless and emotional basket cases into something resembling coherence. And if that weren’t horrifying enough, let me comfort you with the observation that this collection of Democrat party operatives, weepy thermometers, wannabe legislators, and only sometimes actual lawyers is actually the least dysfunctional of the three federal branches of government. Russiagate was a nothingburger in the sense that there was no there there. But in every other sense, it was a carefully engineered hoax that achieved exactly the chaos its architects wanted. It sabotaged Trump’s first term, fueled Trump Derangement Syndrome, criminalized diplomacy, helped trigger the Ukraine war, pushed Russia into China’s orbit, and set in motion so many other negative outcomes we are still seeing today.

I admit, I almost never think of Russiagate any more. It seemed like an obvious nothingburger at the time, and it was. But the campaign around it, especially the involvement of academics and intel agents, was and is notable (everyone knows media types are propagandists).

Imagine you are a working father living in the Midwest, you make 75k a year. You can support your family, but you're not rich. You worry about paying for college. Then you read about some Somalian stealing $1m out of federal healthcare programs. $1 million for the normal guy would eliminate an enormous amount of his stress. The college thing would be covered. Retirement wouldn't appear so daunting. It's why guys like this buy lottery tickets. And instead he pays into the system and watches "newcomers" make a complete ass out of him. This fraud is bad financially, but it just makes a mockery of all the hard work of normal people and tears away at the social fabric.
