Justice Thomas just forced the birthright citizenship debate back to first principles. Solicitor General Sauer laid it out: The Citizenship Clause of the 14th Amendment was written to OVERRULE Dred Scott and secure citizenship for freed slaves who had DOMICILE here and owed ALLEGIANCE to no foreign power. "Subject to the jurisdiction thereof" means full allegiance, not mere presence or subjection to our laws. The text even uses "reside," which at the time meant domicile. The Framers weren't handing automatic citizenship to everyone born on U.S. soil regardless of allegiance.
