𝗝𝗨𝗦𝗧𝗜𝗖𝗘 𝗚𝗢𝗥𝗦𝗨𝗖𝗛 𝗝𝗨𝗦𝗧 𝗗𝗘𝗦𝗧𝗥𝗢𝗬𝗘𝗗 𝗠𝗜𝗦𝗦𝗜𝗦𝗦𝗜𝗣𝗣𝗜'𝗦 𝗔𝗥𝗚𝗨𝗠𝗘𝗡𝗧 𝗙𝗢𝗥 𝗟𝗔𝗧𝗘 𝗠𝗔𝗜𝗟-𝗜𝗡 𝗕𝗔𝗟𝗟𝗢𝗧𝗦 𝗜𝗡 𝗙𝗥𝗢𝗡𝗧 𝗢𝗙 𝗧𝗛𝗘 𝗘𝗡𝗧𝗜𝗥𝗘 𝗖𝗢𝗨𝗡𝗧𝗥𝗬 This is Watson v. RNC — argued at the Supreme Court today. The question: does federal law require ballots to actually reach election officials by Election Day, or is dropping a ballot in a FedEx box close enough? Justice Gorsuch identified the contradiction at the heart of Mississippi's argument and refused to let go of it. Mississippi's brief repeatedly said ballots must be "submitted to election officials" by Election Day. But they also argued that handing a ballot to a common carrier — FedEx, the Postal Service — satisfies that requirement. Gorsuch's response: those two things don't add up. 𝘍𝘦𝘥𝘌𝘹 𝘪𝘴𝘯'𝘵 𝘢𝘯 𝘦𝘭𝘦𝘤𝘵𝘪𝘰𝘯 𝘰𝘧𝘧𝘪𝘤𝘪𝘢𝘭. Then he dropped the hypothetical that made everyone in that courtroom uncomfortable. Imagine a state where a large portion of voters mail their ballots on or near Election Day. The day after the election, a bombshell story breaks — a candidate's scandal, or evidence of collusion with a foreign power. The losing candidate urges voters to recall their ballots. FedEx will do it — you can call and cancel a delivery. And it swings the election. 𝗗𝗶𝗱 𝘁𝗵𝗲 𝗲𝗹𝗲𝗰𝘁𝗶𝗼𝗻 𝗵𝗮𝗽𝗽𝗲𝗻 𝗼𝗻 𝗘𝗹𝗲𝗰𝘁𝗶𝗼𝗻 𝗗𝗮𝘆? Mississippi's lawyer said yes. Gorsuch pushed: even though it changed the outcome? The lawyer had to admit: yes. Gorsuch's response: 𝘵𝘩𝘢𝘵 𝘩𝘢𝘴 𝘵𝘰 𝘣𝘦 𝘺𝘰𝘶𝘳 𝘢𝘯𝘴𝘸𝘦𝘳, 𝘥𝘰𝘦𝘴𝘯'𝘵 𝘪𝘵? When the lawyer insisted Mississippi law prohibits ballot recall, Gorsuch asked him to show where. The lawyer couldn't. Gorsuch had read the statute and the regulations himself — and the regulation says a ballot is final when "marked accepted." That doesn't prohibit recall. It actually permits it. This ruling is expected in June or July — right before the midterms. 𝗜𝗳 𝗚𝗼𝗿𝘀𝘂𝗰𝗵'𝘀 𝗹𝗶𝗻𝗲 𝗼𝗳 𝗾𝘂𝗲𝘀𝘁𝗶𝗼𝗻𝗶𝗻𝗴 𝗿𝗲𝗳𝗹𝗲𝗰𝘁𝘀 𝗵𝗼𝘄 𝗵𝗲 𝗶𝗻𝘁𝗲𝗻𝗱𝘀 𝘁𝗼 𝘃𝗼𝘁𝗲, 𝘁𝗵𝗲 𝗲𝗿𝗮 𝗼𝗳 𝗰𝗼𝘂𝗻𝘁𝗶𝗻𝗴 𝗯𝗮𝗹𝗹𝗼𝘁𝘀 𝗱𝗮𝘆𝘀 𝗮𝗳𝘁𝗲𝗿 𝗘𝗹𝗲𝗰𝘁𝗶𝗼𝗻 𝗗𝗮𝘆 𝗺𝗮𝘆 𝗯𝗲 𝗰𝗼𝗺𝗶𝗻𝗴 𝘁𝗼 𝗮𝗻 𝗲𝗻𝗱.

U.S. Sen. Tommy Tuberville (R-Auburn) called on Republican holdouts in the Senate Monday to end the filibuster so Congress can pass the SAVE America Act, a voting integrity bill that has been blocked by Senate Democrats. Appearing on Newsmax’s “Rob Schmitt Tonight,” Tuberville warned that failure to pass the bill would have lasting consequences for Republicans. “If we don’t pass this, we’ll never have another secure election in this country because we’ll never have any kind of majority again,” @SenTuberville said. “It’s just amazing to me how we’re letting this opportunity pass us by.” Tuberville said four or five Republican senators have refused to vote to end the filibuster, which currently requires 60 votes to advance legislation. Republicans hold 53 Senate seats, meaning they would need near-unanimous support to break the threshold.
