Appreciate the clarity from @SECGov and Chair @SECPaulSAtkins. 👍 The Five Categories of the SEC Token Taxonomy (2026) Four categories that are generally NOT considered securities: - Digital Commodities: Crypto assets whose value derives from the automated mechanics of a functional, decentralized network and supply/demand forces (e.g., Bitcoin, Ethereum). These fall under CFTC jurisdiction. - Digital Collectibles: Tokens intended for personal enjoyment or collection, such as NFTs, digital art, music, in-game items, and "memecoins" that lack a common enterprise. - Digital Tools: Tokens with a strictly utilitarian purpose, such as memberships, event tickets, credentials, identity badges, or protocol "gas" tokens used for specific functional tasks. - Payment Stablecoins: Specifically those issued by a "permitted payment stablecoin issuer" under the GENIUS Act (federal legislation passed in 2025). These are treated as cash-like instruments rather than investment contracts. The single category that is still a security: - Digital Securities: Traditional financial instruments (stocks, bonds, etc.) that have been "wrapped" or issued on a blockchain. The SEC maintains that "a security is a security regardless of the technology used to represent it."
