For the 5 times I have argued substantive appeals before the Court of Appeal. I feel like I should practice there all my life. The juicy part of it is that they do trial by questioning. Every Judge is so acquainted with your file that if you are not careful you may learn new information from your own record. I also learnt that as much as the first Appeals there are a retrial, do not argue your case afresh. Focus on the key grievances you have against the High Court's decision. Otherwise Kiage JA asked counsel whether retrial means regurgitation of all same arguments at the Trial court. More importantly, law is not pleaded, only facts are. At the CoA, you can use any law available on earth. Such a Learning curve. I am always not a fan of proceeding by written submissions because few HC Judges take time to appreciate the same. ✅️✅️
