The entire narrative comes from the defense of lolicon in anime. Defending fictional anime content is not the same as wanting to "fuck kids" in reality. In 2002, the US Supreme Court (Ashcroft v. Free Speech Coalition) struck down provisions of the Child Pornography Prevention Act of 1996, which infringed on the 1st amendment in serious ways that would have made things like Romeo and Juliet, etc., illegal in the US. Fictional sexual content, anime, therefore, became protected free speech... completely separate from actual pedophilia. No one with normal sensibilities is going to watch movies like American Beauty and Traffic and think that the movie contains illegal CSAM. Essentially, Chibi could have a viable defamation claim when Josh says stuff like this... but these are expensive, 100K USD+ and rarely result in big enough payouts to justify it.
