Initial Tucker Carlson musings: 1. Based on prior outrageous Trump admin misconduct (Mahmoud Khail, KAG, law firm/university discrimination, Comey, Powell etc. etc.), I start with the assumption that the government is violating Tucker’s rights. Trump has been so historically and brazenly destructive of individual liberty, that failing to onboard a negative presumption is irresponsible. 2. Privacy/Fourth Amendment: If it’s true Carlson was communicating with members of Iranian government outside the country, any illegal “spying” claim is on shaky ground. The CIA could have obtained access to Section 702 surveillance which incidentally scooped up his comms, in which case Tucker is probably SOL; doubtful gov’t would need a warrant (admittedly SCOTUS has not squarely confronted), unless perhaps they were querying for Tucker specifically. If they’re building a FARA case, maybe feds could get PC for a FISA or criminal warrant anyway, but probably wasn’t necessary. 3. FARA: Exchange of payment is not necessary, but whether we are concerned depends on what Tucker actually was saying to the Iranians. Obviously there is no First Amendment right to act as an unregistered agent of a foreign power, though inconsistent enforcement is definitely a concern here if there is some expansive application of FARA agency principles—i.e., what about Israel. Notwithstanding that generally the government is not required to treat all foreign countries the same, we should consistently enforce FARA. To the extent we feel Tucker’s comms are journalistic or otherwise innocuous, chilling effect on the press would be significant. 4. Without the benefit of more facts, we should be bearish on the prospect of Carlson successfully raising selective prosecution/retaliation defenses—facts are much weaker than Comey as an example. Plus, gov’t has a stronger argument with its counterintelligence goals and the relation to foreign power we are now in active hostilities with—don’t think the courts will hesitate to defer to Trump here.

A weird thing is that whenever I post criticism of AI, the majority of the people agreeing with me seem to be leftists. It’s pretty much the only position I hold that seems to be more popular with the left than the right. It should be the opposite. My whole point about AI (especially AI in creative fields) is that it isn’t human, it doesn’t have a soul, and we cannot surrender our society to an unhuman soulless algorithm even if it makes our lives easier in some ways. It’s very strange that an argument predicated on the existence of the soul resonates with the left while conservatives tend to scoff at it.
