Mr. @JDVance, Invoking the 25th Amendment is no longer a political choice, it is a legal duty to protect both U.S. military personnel and cabinet members from criminal liability: Recent public announcements by the President indicate plans to direct actions that would constitute war crimes under international humanitarian law. 1- Any order that manifestly violates the laws and customs of war is unlawful on its face. United States military commanders and personnel who knowingly execute such an order will be personally exposed to war-crimes charges before domestic courts (Uniform Code of Military Justice, 10 U.S.C. §§ 918, 920) and international tribunals. The defense of “superior orders” has been unequivocally rejected since the Nuremberg Tribunals and does not shield individuals from criminal liability. 2- The Cabinet, as the principal officers of the executive departments, bears both a moral and a legal duty to prevent the commission of war crimes by the United States. This duty flows from the Cabinet’s oath to support and defend the Constitution, from the President’s own obligation under Article II to “take Care that the Laws be faithfully executed,” and from the international-law duty to prevent and suppress grave breaches of the Geneva Conventions. 3- The Cabinet is empowered to invoke the procedures of the 25th Amendment (Section 4) to declare the President unable to discharge the powers and duties of the office. This mechanism exists precisely for situations in which the President’s continued exercise of authority would cause irreparable harm to the nation and to the rule of law. 4- Failure by the Cabinet to discharge this duty and to resort to the 25th Amendment procedures, when the evidence of impending war crimes is clear, would itself entail legal liability under international law.
