The EU Inc's 28th regime has achieved much but there's no mechanism to build a body of practical corporate law through the judiciary. It will diverge over time. Can't they just embed EU delegated judges in the national courts. If not at the first level, maybe at the appeal level? Maybe the EU courts can be done through Enhanced cooperation so that maybe there is EU Inc and then a set of countries where legal interpretation is uniform. Imo, a 15 country EU inc that's completely uniform versus a 27 country EU Inc that's fragmented is better. The holdouts will converge when they feel left behind or have more sane governments.

@bundeskanzler Please kill the Aarhus convention and EU habitat and EU birds directives. They are used by environmentalists to sue every permit they don’t agree with. Check the Ineos cracker in Antwerp and the inability of any level of Belgian government there to deliver a permit for it.

The complaining mostly stems from a mismatch between what is within a democratic governments remit and what is outside. The Aarhus convention is an international convention, that is joined by member states AND the EU. It is subsequently codified at EU level and then in some member states it’s also reinforced by constitutional interpretation. Other like the EU habitat and birds directives are pure EU law. The codification of policy in various rights, EU laws and treaties that actively undermine entrepreneurial activity (in this case permitting, often destroyed through elaborate court procedures) However, no representation I can vote for would have the power to amend those laws. Only the EU commission, in agreement with the EU council would have the power to amend this but both are indirectly elected and luckily this commission somewhat cares about barriers to entrepreneurship. In Belgium it’s defacto impossible to amend the constitution because it’s a defacto confederation and there is no natural convergence of Overton windows that would make amendments possible. So as a citizen we’re pretty much only left to beg the commission to leave the Aarhus treaty, overrule our own constitutions to empower only the nations with environmental and planning policies, modify relevant EU directives to no longer require “beyond scientific doubt” that no birds or nature reserves may suffer harm and remove the standstill principle that removes a national governments ability to lower environmental protection. Entrepreneurs don’t set out to harm the environment but environmental groups very often go on irrational crusades against entrepreneurs. So yea, Europe is responsible for damaging competitiveness but it’s also the solution to fixing it.

Regulations just cost money to adhere to, it's not what's holding back startups imo. What is missing is that the US has a capitalized pension scheme resulting in trillions of investments rolling over every year while Europe has a PAYGO pension scheme resulting in high tax pressure and lack of investment capital.

Europe has incredible engineering talent, but the regulatory environment makes it incredibly hard to build the next OpenAI or Anthropic here. While the US focuses on scaling compute and advancing agentic AI, European regulators are focused on writing rulebooks for technologies that don't even exist yet. If we want to keep our best founders, we need to make Europe a sandbox for innovation, not a museum of compliance.
