@Oluwanonso_Esq @DrJoeAbah Well put! In the U.S most notaries are not attorneys. In fact, in the U.S, a notary is a public servant appointed by a state government to witness document signatures. If this same system is applied in Nigeria, most people would understand @DrJoeAbah's position.

I do know better. That is why I am authoritatively adding my voice to this conversation. I will not over-simplify the value of a lawyer in a commercial transaction. At the same time, I will not over-glamourize the profession or justify unconscionable practices. This is @DrJoeAbah's post that started the controversy: "Maybe I should even apply to be a Notary Public. One Lagos SAN’s Abuja office once wanted to charge 10% of the value of my UK property to witness my signature on a mortgage application form. I offered them N5k, but they said they don’t take that kind of money." The transaction here was to notarize a foreign document pursuant to Section 2(a) of the Notaries Public Act which states that "A Notary Public shall witness the execution of local and international documents such as ...." My tweet mirrored the language of the law. The Act does not confer any additional obligation on a Notary Public beyond witnessing the execution of the documentation. I have seen some tweets attempting to conflate the role of a notary public under Section 2(a) of the Notaries Public Act with the role of a lawyer acting as a legal representative/adviser to the transaction under Section 22 of the Legal Practitioners Act. The two responsibilities are distinct and should not be mixed up. The Notaries Public Act 2023 also fixes the minimum professional fees for attesting to deeds at 20k. So how did this SAN move from a minimum of 20k NGN as stipulated by law to request for 10% of the purchase price of a foreign property. The 2023 Notaries Public Act envisages 20K as a reasonable minimum fee for witnessing such document, and it does not input any additional obligation on the notary beyond the common law responsibility of attesting that the persons who sign the deed are indeed who they claim to be. What additional risks beyond the above stated statutory function of notarising the transaction warrants a percentage-based billing? We took an oath when we were called to the Nigerian bar to uphold the constitution and ensure that the highest standards of fairness and justice is upheld in the discharge of our obligations.

On today’s episode of Nigeria has to be productive. 1. Increase minimum wage to match today’s realities. 2a. Implement plans to reduce food inflation; food is responsible for 51% of the data (CPI) used to calculate inflation in Nigeria. 2b. Provide buses and trucks using CNG to transport goods across the country at a lower price. 2c. Improve security in food baskets and agricultural areas. 3a. Strongly discourage the importation of things we CAN make ourselves. Importation should be to add value to end products, not just trade. 3b. Mandate the banks via CBN, starting with BOI, development banks, and commercial banks to finance manufacturing and industrial ventures at a lower rate. 3c. Some people will try to exploit 3b, send them to correctional facilities after very quick and just trials. Send a strong message that productive ventures are encouraged and they are the most assured way to financial success in (new) Nigeria. 4. Increase interest rate for consumer loans temporarily (while keeping the interest rate for manufacturing and industries low), this will encourage FDI into the country, if done properly, higher interest rates will make investing in Nigeria more attractive, this will draw-in more FX, make the Naira stronger, penalize/discourage the FX hoarders and economic racketeers. After some months depending on economic conditions, reduce the interest rates as the exchange rates stabilizes due to the increase in local production meeting local demand and substituting importation. This reduced interest rate will encourage consumer spending which would lead to higher economic growth ⬆️. 4b. Show you will find those who want to exploit the economy and they will have their day in court. If found guilt send some of them to correctional facilities. We need to discourage impunity. 5. Increase the tariff of goods we can produce in Nigeria, encourage the purchase of Made in Nigeria goods and services. Encourage the usage of the Naira more. 6. Encourage the use of CNG. Engage domestic vehicle manufacturers/assemblers on making CNG compatible vehicles. CNG is significantly cheaper than petrol, and Nigeria is a gas nation. Encourage stakeholders to invest in CNG infrastructure. ….. and many more.

You don’t have to. We all have a role to play if we want to replicate what works elsewhere. If we normalize buying made-in-Nigeria vehicles and they account for over 60% of the new-car market, then in 5–10 years we will naturally have a strong second-hand market of made-in-Nigeria vehicles, with cars selling for as low as the equivalent of $1,500. I have explained this repeatedly here on X and in several of my interviews. This is one of the key long-term reasons I am passionate about building a thriving automotive manufacturing and assembly industry in Nigeria.

It’s surprising how many people don’t realize that cabinet ministers rank above all service chiefs. As long as their orders are lawful, all service chiefs are required to follow directives from a minister. In particular, the Minister of Defense has the authority to issue orders to the service chiefs.
