Justice Nagarathna pointed out the inherent risks in live-in setups — there's no marriage bond, and either party can walk away. Turning a breakup into a criminal case after years of voluntary cohabitation complicates the issue of ongoing consent. 6. The Supreme Court clarified that the woman can still pursue civil remedies, such as maintenance for the child. The focus, the bench suggested, should be on practical support for the child rather than criminalising the end of a long consensual relationship. 7. This isn't about denying genuine cases of deception or coercion, but recognising that prolonged, voluntary shared life (including intimacy and parenthood) changes the legal picture when consent is later withdrawn retrospectively. 8. Finally, Indian courts seem to be drawing a line: protect genuine victims, but don't weaponise criminal law against the natural messiness of relationships between consenting adults.

Beaten in police custody. Tortured. The Crime Branch took over. The woman confessed. DNA cleared Gulati. He was discharged in 2001. But the case against the conspirators dragged 26 years. Gulati attended court over 20 times waiting to testify. Every time the defence asked for an adjournment. He died in 2014 still waiting. On April 4 2026 the Delhi High Court finally upheld conviction of the lawyer and the sub inspector. The judge wrote this. Sushil Gulati never got justice during his lifetime.
