There are two broad categories of individuals in terrorism related cases, those who surrender and those who are arrested. Under International Humanitarian Law and Law of Armed Conflict, once a person is hors de combat, meaning out of the fight, they are protected. At that point, the obligation shifts from the use of force to lawful handling. Such individuals cannot be harmed or summarily punished and must be processed through established legal procedures. This is not optional, especially for Nigeria as a signatory to the Geneva Conventions, where Common Article 3 clearly provides for humane treatment and judicial guarantees. In the case of arrests, the realities of conflict environments must be properly understood. Individuals may be detained based on acts of commission, intelligence, suspicion, or proximity to hostilities, and not all those detained are ultimately found culpable. This is precisely why structured systems exist for screening, investigation, prosecution and where appropriate rehabilitation, to ensure that responsibility is determined through due process rather than assumption. It is therefore important to emphasize that arrest is not proof of guilt, as evidence must be tested and established in court. On that basis, if you claim to have evidence of wrongdoing, the appropriate course of action is to present it to the Federal Ministry of Justice, which is responsible for prosecution under Nigerian law, including the Terrorism (Prevention) Act and the Administration of Criminal Justice Act. The reality remains that individuals who pass through the Deradicalization, Rehabilitation and Reintegration programme are not randomly selected. They have gone through judicial processes and are either acquitted, have served their sentences, or have been assessed by competent legal authorities as eligible within the provisions of the law.

There are two categories: those who surrender and those arrested. Arrest/guilt: In war zones, people get picked up based on suspicion, intel, or proximity. Not everyone detained is guilty. That’s why we have courts. Evidence must be tested. If you have proof someone is a killer, take it to the Federal Ministry of Justice. They prosecute under the Terrorism Prevention Act.
