The X account of David Peterson (@davidgpeterson), General Manager at @ProtonVPN, has been suspended in India. This came after he posted about a 150% surge in hourly registrations for Proton VPN from India, following @telegram's temporary ban in the country. Proton VPN is a virtual private network (VPN) service that allows users to change their apparent online location. By using a VPN, people in India could route their internet traffic through servers outside the country and access blocked platforms such as Telegram. The suspension of his account adds to the growing trend of content takedowns and account suspensions ordered without transparency. Most of these orders are being issued under Section 69A of the IT Act, which allows the government to issue blocking orders on broad grounds such as national security or public order. Read with Rule 16 of the Information Technology (Procedure and Safeguards for Blocking Access of Information by Public) Rules, 2009, this provision requires confidentiality regarding all requests and complaints received as well as actions taken. As a result, the person facing information blocking may never be heard or provided a reasoned order on why their content is blocked online. Apart from causing a chilling effect on free speech, this violates basic tenets of natural justice. SFLC.in has filed a PIL in the Hon’ble Supreme Court challenging the constitutionality of Rule 16. We have urged the Court to quash or set aside Rule 16.
