
As-salāmu 'alaykum wa raḥmatullāhi wa barakātuh,
Following our publication addressing Mut'ah al-Ṭalāq in response to Dr. Hatem al-Haj's fatwa issued through AMJA, we became aware that AMJA has developed an official Family Code and standardized Marriage Contract promoted for use by Muslim couples and families in America. Our review reveals that both documents contain what effectively constitutes a form of alimony, among other substantial concerns.
The marriage contract warrants particular attention given its legally binding implications for couples who adopt it. After careful examination, we cannot recommend its use in its present form.
We have accordingly prepared a comprehensive scholarly evaluation of both documents for the benefit of the academic and juristic community. It is our sincere hope that AMJA will give due consideration to the issues raised and reconsider its position on these matters. This paper identifies and analyzes the problematic provisions found in both the Family Code and the standardized marriage contract.
