Liberal Justice Elena Kagan reportedly threw a HUGE temper tantrum over the publication of the Dobbs decision. She was screaming at Justice Breyer so loud that “the walls were shaking,” @mzhemingway tells me. @JonathanTurley Should Republicans nuke the filibuster to pass the SAVE ACT? Do the ends justify the means in this case? Seems that if we don’t, they’ll win every future election by illegal means. Spanberger already wants to make hand counting ballots illegal.

@9Sling @marcthiessen 🧵This will tilt the mid-census adjustments as follows: California 48 Dems/5 Reps. Texas 8 Dems/30 Reps. Virginia 10 Dems/1 Rep. Which is why you are now hearing Florida talk about possibly doing the same. California started the midterm nonsense and red states are catching up.

@9Sling @marcthiessen 🧵Then, Virginia had a bipartisan commission that divided the state fairly (6 Dems/ 5 Reps. but Dems ignored both the laws requiring a specific timeframe & those requiring contiguous geographic districts. If it stands, they will gain 4 seats going totaling 10 Dems & 1 Rep

California went around the Citizens Redistricting Commission (already heavily Dem. map) 5 years early & passed Prop 50. If all the new districts go to Dems, they will gain 5 more seats for a total of 48 D’s/5 R’s.

@9Sling @marcthiessen If you want to start over or have a Constitutional Convention, do it. Maybe we need reform? Maybe we need 1 Rep/each county? But within the current system, ENFORCE the existing laws. “I pledge allegiance to the flag of the USA & TO THE REPUBLIC…” the laws of states/territories.

The "yes" vote has won Va's redistricting referendum — but the legal fight is just beginning. Four Va Constitutional challenges are now teed up: THREE challenges to the amendment process itself: 1️⃣ First passage was invalid. The amendment was taken up during a special session convened in 2024 for budget purposes. The General Assembly's own call to the Governor (under Art. IV, §6 and Art. V, §5) and its governing resolution (HJR 6001) limited the session's scope. Expanding it to include a constitutional amendment on redistricting required a two-thirds vote that never occurred. A Tazewell County judge found this action "void, ab initio." 2️⃣ Art. XII, §1 requires that after first passage, a proposed amendment be "referred to the General Assembly at its first regular session held after the next general election of members of the House of Delegates." An election must intervene between first and second passage. Here, first passage occurred during an election cycle — not before an intervening one. 3️⃣ Art. XII, §1 requires the amendment be submitted to voters "not sooner than ninety days after final passage by the General Assembly." The timeline from second passage to the April 21 vote did not satisfy this requirement. Plus ONE challenge to the proposed maps: 4️⃣ Art. II, §6 requires that "every electoral district shall be composed of contiguous and compact territory." The proposed congressional maps violate this contiguity requirement (rather badly). Next stop, court. Stay tuned.

I could care less about Virginia specifically. Many, many states have done this and it's time for all of it to be put to an end in this country. People need to stop pointing fingers and whining about states like Texas and Virginia redistricting and start demanding better of our legislature in resolving this by federal law. In addition, the president needs to keep his nose out of state's business.

@9Sling @marcthiessen That’s what Virginia just overturned. They already had a bipartisan commission that divided the 11 districts into 6 blue/5 red. That balance also reflects the popular vote in the 2024 election when Harris got 52% over Trump 47%. An illegally constructed amendment = tyranny.🤯😡
