סיפור משפטי לשבת: זוגיות להט״בית, דכאון מגזרי, דעה קדומה ומאבק על עשירית הנקודה במבחן רופאה ניגשה לבחינה לצורך קבלת תואר מומחה ברפואה משפחה. היא קיבלה בבחינה 64.4 אלא מה? הציון העובר: 64.5 ומעלה. 😱😱 בצר לה, היא הגישה עתירה מנהלית בדרישה לפסול את אחת השאלות, כדי לקבל ציון עובר. שאלה מס׳ 12 במבחן נוסחה כך: ״בת 34 בריאה. ללא היסטוריה משפחתית של מחלות לב או סרטן .מגיעה לביקורת שגרתית. מרגשה טוב ללא תלונות, באנמנזה מספרת כי נמצאת בזוגיות מונגמית עם אישה מזה שנתיים. איזה בדיקה מומלצת לביצוע כעת? 4 האפשרויות היו: א. בדיקת שתן לSTD ב .סקר לדיכאון ג .ממוגרפיה ד. בדיקת () LIPOPROTPIN הרופאה הנ״ל ענתה א׳. התשובה של הוועדה הבוחנת הייתה ב׳. היא עתרה לבית המשפט בטענה שניסוח השאלה "איזה בדיקה מומלצת לביצוע" מעניקה שיקול דעת נרחב לנבחנים במענה לתשובה. אבל מעבר לכך היא טוענת שמכיוון שהמטופלת באה לביקורת שגרתית בלבד, היא מרגישה בטוב וללא תלונות - אין מקום להפנותה לבדיקה כלשהי ובוודאי לא לבדיקת סקר לדיכאון אשר לגביו אין תלונות כלל. לטענת הרופאה שהגישה את העתירה, יש לפסול את השאלה כי מה שעומד בהנחת היסוד של הוועדה היא שברגע שאשה היא "לסבית" הרי "שחזקה" שהיא סובלת מדיכאון. לדבריה, עולה מפורשות מהשאלה שאין שום סיבה לחשוד בדיכאון, וממילא החלטת הוועדה לפיה אשה לסבית חייבת בדיקה נגד דכאון היא פגם בשיקול דעתה היורד לשורש שיקול הדעת המנהלי באופן העשוי להצדיק התערבות שיפוטית. השופטת הדס עובדיה נטתה להשתכנע, ובדיון שהתקיים לפני כמה שבועות היא דחקה בוועדה של ההסתדרות הרפואית לשקול לפסול את השאלה בשל חשש מדעה קדומה כלפי אוכלוסיית הלהט״ב. בסופו של דבר, הוועדה התכנסה שוב והחליטה שאין מקום לפסול את השאלה. לדברי הועדה, ״אוכלוסיה זו נמצאת בסיכון ללקות בדיכאון והדבר הוא בבחינת עובדה רפואית ברורה, שצריכה להיות ידועה לכל מומחה ברפואת משפחה. ביצוע סקר לדיכאון בהפניית שתי שאלות פשוטות לאישה שנמצאת בזוגיות עם אישה אינה משום חוסר אמון בדברים שמסרה לרופא המשפחה או חלילה, ביטוי שיפוטי, פוגעני או מפלה כלפי קהילת הלהט"ב, אלא להפך. מדובר בביטוי לגישה רפואית אחראית, רגישה ומקצועית המתאימה לצורכי המטופל הקונקרטי״. הוועדה החליטה להטריל, ועשתה הפוך על הפוך: ״דווקא ביטול השאלה עלול לשדר מסר שגוי, לפיו אין מקום לשאול שאלות רפואיות לגיטימיות בהקשר זה, ולהביא לתת-אבחון ולפגיעה באיכות הטיפול הרפואי״. כלומר, הפגם הוא לא בשאלה אלא במי שחושב שהשאלה הזו פגומה. השופטת הדס עובדיה החליטה לדחות את העתירה, וקבעה שאין מקום להתערב בשיקול הדעת של הוועדה שמומחית לנושא זה. העתירה נדחתה אתמול. דונו!

I have to admit, that coding is truly dead. I use codex for my work and it's very good. At the same time, it doesn't replace me (yet?): I guide agent, describe features and requirements, control code efficiency. Development is fun again. I'm now productive af.

Mediabunny v1.20.0 is another big milestone for the project: it can now read & write transparent videos! 🚀 All directly in the browser, super fast, no server needed. This was more challenging that it seems on the surface (took over 1000 LOC). A blog post about this will follow!
