The new guidance from @ELCouncil is dismal. They could find themselves in receipt of a legal challenge on very solid grounds. Of particular note: The pool of consultees they’ve used is shallow and familiar, even referencing the dreaded Hate Crime & Public Order (Scotland) Act 2021. How about that for the ultimate threat to worried parents. Ominously, TIE said @ELCouncil statement was “one of the best they have read”. They refer heavily to debunked and unlawful @scotgov 2021 guidance, seemingly ignoring the UKSC ruling. It appears to suggest children age 12-16 have a legal agency which they do not, including but not isolated to ensuring parents are not consulted or included in serious, potentially life altering decisions. Helpfully I suppose, I’m a parent in East Lothian with no plans to let this one sleep. Anyone else…?
