@superwuster Could not agree more. Of course, we fought this battle beginning with US West (CA10 1996) and had largely prevailed in NCTA v. FCC (DC Cir 2009).

@TanyaOCarroll This was also the history of the Do Not Call provisions in US law. To be effective, a simple "applies in all circumstances" opt-out was necessary. Economic theory explains why: if the transaction costs for individual opt-outs are too burdensome, consumers will not bother.

Great opinion from the European Data Protection Board! Another death knell for surveillance advertising (because when given simple one-off choice, staggering numbers refuse consent). Which is of course also why any such tools will be aggressively fought by industry.

The EDPB's opinion on the cookie pledge has just been published! Notably, it states that tools to automate consent refusals (e.g. software settings) can "help to reduce cookie fatigue", but that automating affirmative consent is more complicated, bc consent should be specific
