🚨BPI has just learned of an amendment buried in Kentucky HB 380 that would require hardware wallet providers to reset users' seed phrases on request. This would effectively outlaw self-custody in Kentucky. BPI is sending a letter to the Kentucky Senate informing them of the harmfulness of this language. Section 33 was added as a last-minute floor amendment to a 77-page virtual currency kiosk regulation bill. The underlying bill has political support and is expected to move through the Senate for final passage, possibly within the next week. The mandate is technologically impossible for non-custodial wallets. Hardware wallets are specifically designed so that no one — including the manufacturer — can access or recover a user's seed phrase. Requiring a backdoor for seed phrase recovery breaks Bitcoin's fundamental security guarantees and pushes users toward centralized custodians that are vulnerable to hacks and failures. Kentucky legislators should be protecting their constituents' right to secure their own property. We urge the Senate to strip this provision before the bill reaches a vote. Relevant text below

A safe deposit box is not a bitcoin estate plan. “Just put the seed phrase in a bank box” sounds sensible. But for bitcoin, that usually solves only one problem, physical storage. It does not solve the harder problems: - Does your family know it exists? - Do they know what it is? - Can the right person access it at the right time? - Can they act during incapacity, not just after death? - Is there a documented recovery process they can actually follow? - Have the executor, trustee, spouse, or beneficiaries been prepared? That is the real issue with bitcoin inheritance. The failure mode is rarely: “the words were not hidden well enough.” It is usually: “the right people could not confidently recover and use them when it mattered.” Bitcoin is a bearer asset, that means inheritance planning must go beyond storage and address: governance, documentation, redundancy, authority, and education. A stronger design looks like this: - no unilateral control - documented roles and approvals - recoverable multisig architecture - clear escalation paths - plain-language instructions for heirs and fiduciaries - a process that still works through death, incapacity, device loss, or personnel change That is why we focus on collaborative security and Estate Plan Protocols. Not because Bitcoin needs more complexity. Because families need a process that is actually executable. A hidden seed phrase is not a plan. A workable bitcoin estate plan is one that the right people can find, understand, access, and carry out under pressure. This boils my blood 😠😠 Seeing the IRS demand a full map of every exchange and wallet you've ever touched is a blatant overreach. How do you actually stay safe and keep them out of your life? To be clear: This isn't a routine form. It's only requested during an audit. The statute of limitations is 3 years from when you file your return. That clock starts ticking only once the return is actually filed. That means they CANNOT audit you for tax returns past the 3 year mark. The exception, however, is if you significantly underreport income (25%+). At that point they can go back six years… Here's my straightforward advice as a CPA who's seen this play out: 1. File every return on time! The clock does not start until your return is actually filed. Late or open old returns open up your audit risk even more. 2. DO NOT underreport your income. Doing so keeps that audit window open twice as long. The IRS already has your sales proceeds from exchanges via 1099s. Underreporting doesn't hide anything, and instead doubles the time for them to audit you. 3. Find legal ways to pay as least taxes as possible. I am not saying you should just accept things as they are and bow down to the taxing authorities. But the most effective path to paying less is to comply fully with the code while using every legitimate strategy to reduce or eliminate liability. But don’t avoid them. That will get you in trouble.

NEW IRS FORM IN CRYPTO AUDITS DEMANDS FULL HISTORY OF EXCHANGES AND WALLETS A new IRS form being sent in crypto audits lists 100+ platforms including Coinbase, Binance, Kraken, FTX, and Mt. Gox, as well as self custody wallets like MetaMask, Ledger, and Trezor. Recipients must mark YES or NO for each platform and sign the document under penalties of perjury. The form appears designed to map a taxpayer’s entire crypto footprint across exchanges and wallets, potentially going back years. Missing a platform used long ago could raise questions, while disclosing many may open new lines of inquiry. Tax professionals warn the document could carry significant legal risk and advise consulting a crypto tax attorney before signing.

Bitcoin Core development has its own set of rules, you should have a look at the readme. They write code for users of bitcoin, and the level of changes made go through different standards and process. They don't and should just do whatever the hell they want, which they have, and so users have every right to abandon them as the reference client. No one needs permission to abandon them.
