@DanWolken The value, like mid and minor bowl games, was to get more experience and extra practice for your players to get a jump start for next year but with roster turnover, hard to see much value anymore. Maybe even harmful, players have a more exclusive window to showcase for suitors

@WinterSportsLaw seems identical to when the concept of grant of rights came alone and required you to leave your tv rights ischool left, maybe 15 years ago. It was an attempt to be a super liquidated damage to try to scare schools from leaving. This is another novel concept to tie someone down

Another athlete/school conflict over a rev share agreement. Athlete signed a new rev share/NIL contract and now wants to leave and play for another school. Ole Miss doesn’t have rights to his athletic services, just to use of his NIL.

There are ~70 years of settled law interpreting employment agreements. Judges know that framework. Outcomes are predictable. Risk is priceable. Using NIL deals to do the work of employment contracts just invites novel, uneven precedent.

@EdLawDude Could ncaa get league governance with out some type of anti trust exemption? Clearly coaches abandon jobs all the time in college vs pro leagues that require their existing teams to grant permission. Absent a unified league, there is just litigation regarding liquidated damages

This is a great question & the answer is, in pro leagues, the restriction is enforced through league governance + collective bargaining, not ordinary contract law.

@WinterSportsLaw Clearly college coaches get out of their contracts and often have litigation or a reduced settlement. Does this not happen in pro leagues with players and pro coaches because of the combination of having an antitrust exemption and collective bargaining with the unions?

As mentioned yesterday, Demond Williams’ contract with Washington prohibits him from licensing his NIL rights in connection with another school. Will be a big part of this dispute. This isn’t an employment agreement, so UW can’t stop Williams from playing elsewhere.

- The agreement (1) prohibits a player from entering the portal once signed (this is why UW is refusing to enter his name into the portal) and (2) prohibits the player’s NIL rights to be used by any other school, though the player can sign outside marketing agreements.

@heitner Only way it could work is if they are employees of the ncaa / football league, I think. Too many issues with public employees in many states & one of the big issues will be a salary cap / salary minimum and player portability. Also developing transfer fees for smaller schools.

Many athletic directors, losing faith in waiting for Congress, are now seriously considering collective bargaining with players. Do athletes need to be employees? Who should be the bargaining unit? How many bargaining units and agreements should there be? Do athletic directors even have the power to implement change?

@PeteFiutak With the transfer portal, wonder if it seen as a risk/ detriment to let your younger players showcase and get more offseason portal interest. Plus again with the higher transfer rate, the idea of seasoning your younger players is diminished, seasons seem more standalone, maybe 🤷‍♂️

@WinterSportsLaw The business that has the most direct relationship with college athletics and would be most advantageous to its business is tv networks. Seems like the network partners should have NIL deals with conf teams to get better talent and get higher ranked teams which helps tv ratings

What Dillingham is expressing was the prevailing thought when NIL was first allowed, that schools in big cities would have an advantage b/c of their biz base. That hasn’t necessarily turned out to be the case. Because it’s harder to get businesses engaged than people think.

@Aaron_Musfeldt @wilnerhotline I thought the same thing, just give a percent of the revenue distributed by the conference to the particular school. I guess the key is the extended grant of rights, most schools would not be worth as much in future revenue if they were not tethered to the bigger schools.
