End unjust US citizenship based double taxation

Recent media coverage of Americans moving abroad has mostly failed to do any justice to all the difficulties those "eagles" are going to find once they get abroad, including double taxation and absurd filing requirements with punitive penalties for non-compliance. It's high time for Congress to right this injustice by giving Americans abroad the same freedom the first pilgrims sought when they moved to new shores. To understand why, please visit taxfairnessabroad.pulse.ly/rvghao7iso. @WaysMeansCmte @WaysandMeansGOP @SenFinance @SenateFinance @YourVoiceAtIRS @RepLaHood @SenToddYoung

At least some people realise the dangers of becoming a resident in the "land of the free." #FATCA #CBT Try freely leaving with your wealth and particularly that with which you arrived with!

@MikeBre14267200 Tell those who promote immigration of HNWI to USA. They usually don’t highlight these features of US citizenship. Instead prefer talking about food safety and good schools (as if one needed US citizenship to enjoy these). @imidaily @yaminfouzi @wander_investor @MyLatinLife

These jurisdictions charge an “exit tax” in one form or another: 🇺🇸 🇯🇵 🇦🇺 🇫🇷 🇪🇸 🇳🇱 🇦🇹 🇩🇰 🇳🇴
Some are legacy destinations. But: What may make sense for the middle class does often not make sense for HNWI.
Don’t be fooled by brands! Nation branding can lead to tax implications.

@ajlamesa It should not need to be said, but a tax system so egregious that people are effectively forced to not be American anymore is clearly wrong.
There is nothing normal in making other nations residents, citizens and taxpayers file US taxes as well, the result is a disaster.

The United States has been doing this for over a century, and the government’s official position is that they have a propertied right over the citizen (Cook vs Tate, 1924), which the US Treasury Department reaffirmed in 1998.
This is the final destination and so-called rational for citizenship based taxation. The government’s legal theory is that citizenship itself constitutes a bilateral relationship that is the taxable nexus (not territory, not property location, not domicile). The government essentially claims a perpetual interest in the citizen’s person and property by virtue of that citizenship relationship alone.
And this has been utterly shackling and even life destroying for many, if not most, Americans abroad, as they cannot open many kinds of financial accounts nor save for retirement, as being subject to two tax codes is always incompatible *somewhere*, and often is it in BASIC financial operations like disposal of an asset, like a home, loans, and most often: retirement savings or savings for future child expenses like education.
The United States should be a cautionary tale, and NOT something to be emulated for vindictive political ends. It denies your citizens freedom to move and effectively strips their right to retain citizenship, as evidenced by how many Americans report feeling forced to renounce due to tax compliance and denial financial services. Which is arguably in substantial contradiction to the Afroyim v. Rusk that said Congress cannot pass laws that effectively involuntarily abridge, affect, take away, or destroy citizenship. But nevertheless, citizenship based taxation continues to this day, despite its constitutional dubiousness, and was originally passed because of similar vindictive calls to action that this article is demonstrating.
Do not go down this route. It fundamentally damages the value of citizenship and effectively gives the government a dangerous right to be capricious over the very citizenry it is supposed to serve.

@DutchNewsNL Nobody is giving up their citizenship and moving abroad, it's people already abroad that are sick of being second class people unable to have normal lives as the USA hounds them for taxes. #FATCA

@IRS_MEDIC We both know that the system is so complex, so punitive, laden with hidden traps that attempting to comply is usually far more dangerous than simply ignoring the whole rotten mess. In many years now I have seen the same pattern, those who try to comply are the ones getting hurt.

Good article from @ACAVoice underscores the necessity of delivering the message to Congress that U.S. @citizenshiptax and #FATCA are bad for the United States. It's time for Congress to act!!

The U.S. Department of State today filed a final rule, effective March 13, 2026, reducing the fee for renouncing U.S. citizenship (Certificate of Loss of Nationality) from $2,350 to $450. The Association des Américains Accidentels (AAA) welcomes this decision, which acknowledges the necessity of making this fundamental right accessible to all. This victory is the direct result of six years of relentless legal action and advocacy.
"As Thomas Jefferson stated in 1779, voluntary renunciation of one's nationality is a natural right inherent to all men. The U.S. administration is not above its own Constitution. This fee reduction is a concrete first victory — but our fight to have the right to renounce recognized as a fundamental constitutional right continues." — @FabienLehagre, Founder and President of the AAA

In December 2020, the AAA and 20 Accidental Americans of 10 nationalities filed a complaint before the U.S. District Court for the District of Columbia, challenging for the first time in history the constitutionality of the $2,350 fee. On January 6, 2023, under direct pressure from this lawsuit, the State Department notified the court of its intention to reduce the fee — but never finalized that decision. In June 2025, the AAA sent an official letter to Secretary of State Marc Rubio demanding immediate publication of the rule. In January 2026, the AAA filed a new federal action: since the 2023 announcement, at least 8,755 individuals had paid $2,350, generating more than $20.5 million in unjustified revenue. On March 13, 2026, the final rule will be effective.

The State Department acknowledges in this text the difficulties faced by U.S. nationals residing abroad as a result of FATCA: inability to open a bank account, obtain a mortgage, or invest for retirement in their country of residence. These hardships are a direct consequence of Citizenship-Based Taxation (CBT), which subjects Americans abroad to unjust double taxation. Ending this double taxation was a campaign pledge by @POTUS, which the AAA calls on him to fulfill without delay.

A fundamental question remains pending before the U.S. Court of Appeals for the D.C. Circuit (No. 23-5034): is the right to renounce one's nationality a constitutional right that can neither be monetized nor restricted?

We need your help putting the #IRS double taxation kraken back in its tank! Some in #Congress still believe Americans living abroad all have the best of both worlds -- being U.S. citizens and living in postcard destinations. They don't see or feel the pain of #doubletaxation, #FATCA, #FBAR, #GILTI and other financial shackles and insults. #taxfairnessnow

@ExpatriationLaw @DrewHinshaw @JoeWSJ @citizenshiptax An awful lot will find out the hard way just why there are waiting lists to renounce US citizenship.
Even those that know the US taxes its citizens abroad almost certainly do not have a clue how much havoc that causes. #FATCA

The US effectively has a financial “Berlin Wall” due to its citizenship based double taxation which it imposes on its citizens who live overseas. Because of FATCA Americans also have difficulty opening bank accounts. They live under the constant fear of egregious penalties for any filing errors or form omissions. If they want to renounce there’s also an exit tax for covered expats. Trump pledged to end the double taxation of Americans abroad but unfortunately so far this hasn’t happened.
English

If you run your country poorly you need a Berlin Wall or an exit tax. Or you could avoid stupid big government policies. If that is not too much to ask for from politicians.

About 4,820 Americans renounced citizenship in 2024 (third-highest on record), with 1,285 in Q1 2025 alone—on track to top that. Most were long-term expats citing taxes/FATCA.
Separately, ~180k US citizens moved abroad in 2025 to 15 countries with data (per WSJ/Brookings analyses). Total living abroad: ~5.5M (AARO est.) to 9M (prior State Dept.).
Renouncing is rare vs. moving—vast majority of expats keep citizenship.

Americans abroad are counting the days until the Residence-Based Taxation for Americans Abroad Act is reintroduced and we can see light at the end of the double taxation-FATCA-FBAR tunnel.
