Lt. Daley explains that he went to Kelsey Fitzsimmons with 2 other armed men to surprise her with an order that she must hand over her baby to them because her fiance who stood her up earlier in the day went to a judge an obtained an ex parte order against her. Apparently his vast experience did not tip him off that this may have been a volatile situation requiring a social worker.

@DoctorTurtleboy Jen McCabe is a balanced, clear minded, non-criminal, dedicated mother.
Sadly, Fitzsimmons is currently unbalanced, has a history irrational behavior and criminally charged with multiple offenses…but I’ll pray she gets the much needed help.

The contrast is startling. Kelsey Fitzsimmons is what Jen McCabe thinks she is - a normal Mom. Her arms and hands are full as she alone cares for her baby, while texting Justin Aylaian who stood her up by going to a court and telling lies to obtain an order. She is then followed by 3 armed men, one of them wearing gloves, who showed up to her house unannounced and told her they were taking her baby.

Something to think about because this actually affects the community of North Andover if they've made a practice of literally hiring convicted criminals to police the town.
Conversely, Officer Noonan attempted to deescalate, gave proper verbal commands in the split seconds he had while Kelsey Fitzsimmons racked her firearm, and ultimately saved her life in every possible scenario that is alleged to have occurred in that room.

So the states theory is, she's irate, desperate, and Noonan is an obstacle to getting what she wants - her anger out on Justin and her baby back without waiting 12 days for court. That is not an implausible theory. She has reason to lie, because trying to shoot a cop is a crime. Trying to shoot herself in this situation is plausible, but doesn't really account for ambushing Noonan, which means he would have to be lying, sure. He could have a reason to lie, but less so, because regardless she pulled out a gun making it a justified shooting. Internal affairs found it as much. Thats just how that works - don't pull a gun on a cop. So I find her reason to lie more compelling than his. This is an assault case. She's not doing time either way. People should be more upset and concerned with how she was ever given a gun and a badge, considering her history and the ultimate outcome. If this hadn't happened we could have ended up with Kelsey on the other end of a police shooting, and it all possible terrible outcomes are 100% on @NoAndoverPolice and their abhorrent hiring process. How many other officers do they employ with out of state convictions, including cases with judicial findings of "domestic violence", something that precludes gun ownership in many states?

So flattered to have been chosen as defense lawyer of the year by the Middlesex Bar Association. Also very pleased with their choice of Graham Van Epps as prosecutor of the year. My last jury trial before the first #KarenRead trial was against Graham. He is an incredibly skilled trial lawyer, someone who displays the highest standards of ethics. Great guy, great choice.
