She has gone off tangent using this as allegations on her which is silly

“Justice Sharma said that even if her relatives are empanelled on Government panels, Kejriwal was still required to show the proximity, relevance, and impact of such empanelment on the case in hand or on the decision-making power of the Court.” WRONG. ABSOLUTELY WRONG. How can the burden to “prove” this be put on a litigant? It is practically impossible. And hence the jurisprudence on recusal requires a litigant to not “prove” bias but only properly convey their “reasonable apprehension” of possible bias due to circumstances such as this. Justice Sharma has got it totally wrong here. The higher courts ought to correct this disastrous judgment on recusal.

Nobody wants this kind of overarching generalized recusal jurisprudence. Anyways, law too allows to invoke recusal proceedings only when apprehension of bias is present. Let's talk about this case.

IMHO, she is biased to the core without an iota of integrity, and doesn't deserve to be a part of the judiciary.

@LegalTalwar Let’s not mix identity with institutional responsibility. A judge must be evaluated on legal reasoning, not gender or sympathy. Bias should be called out, but not used to avoid scrutiny of the judgment. Motives aside, legal questions still matter

The reaction to Justice Swarna Kanta Sharma has been gendered because I have never seen a judge having to justify what their kids do while sitting on the bench. The pronouncement was emotive for a reason, and the issue became politically charged because of a failed politician unable to deal with losses, accountability for corruption after exposure to VIP culture as Ex-CM. I stand by Ms. Sharma, the woman. Not the judge.

@SauravDassss @iyer_sk @TweetinderKaul Doesn't matter even if someone decides to write an epic, a thesis, anything trying to justify the judge, the more they justify, the more biased the judge looks. She may someday become the CJI bcoz of her powerful patronage, but end of day - she is biased.

The principle here is that the judge should be SEEN to be fair. If multiple litigants have an apprehension that she won’t be impartial in the case given her children’s boss is arguing the matter, who also happens to mark every case to them and thereby ensure how much money they are paid, visibility they get, standing they get, proximity to power they get, how quickly they rise or fall, then is that not reasonable APPREHENSION of possible bias? Any judge who has recused at any point in their career has heard and is hearing tons of cases—that is irrelevant. What matters is the present case and it is no doubt a politically sensitive one. You may not care for the politics of law but it increasingly controls today’s outcomes. Every other judge may not have their children empaneled and their boss arguing before them. That perception of impartiality ought to be maintained in a case like this. In any case, nothing needs to be proved. I still can’t understand how you think this reason, along with other reasons when seen in isolation are easy to shrug off but when seen together are not reasonable enough to apprehend a strong possibility of bias.
