The Special Tribunal already ruled: the contract was unlawful, the process was irregular, and profits must be paid back. That judgment focuses on the 2020 tender and the parties involved. Anele is not cited in that process. Let’s stick to what’s actually in the ruling, not assumptions.

The issue is not that nothing was delivered. The PPE was delivered. The problem is that the tender was awarded irregularly and at inflated prices. So what happens now is this: Government paid, for example, R14 million. SIU then goes back and calculates what those masks and suits should have reasonably cost at the time (market price), plus legitimate costs like transport, storage, etc. That total = the “real” cost of the contract. Anything above that is considered profit made from an unlawful tender. That’s the amount that must be paid back. So they’re not refunding the full R14 million, because the goods were actually supplied. They’re refunding the inflated portion. In simple terms: They keep the cost. They return the excess.

From my understanding, these people are supposed to pay ONLY the profit earned - not the full amount. If the goods were delivered (and I don't get a sense from the statement below that that's in dispute) The items would have to be priced at National Treasury benchmark rates and that total deducted from the full amount paid.

The contracts, valued at R1,080,000.00 for 60,000 surgical masks and R13,297,500.00for 150,000 protective medical jumpsuits, were declared constitutionally invalid, unlawful, and void.
