As accounting authority and head of SAPS, Gen Masemola bears overall responsibility for procurement under the PFMA.
He testified that he didn't sign off the tender - it "doesn't come to my desk".
It was signed off by the Divisional Head Supply Chain Management.
He also testified he cancelled it at the instruction of Minister Mchunu.
Perhaps he has been summoned to court over his oversight role?🤔
Is it a case of the buck stops with the head?
PFMA does NOT criminalize outcomes.
It criminalizes WILFUL or NEGLIGENT failure to comply with legal duties.
In cases like Masemola's where officials allegedly provided confirmation to him that a bidder IS COMPLIANT, the law recognizes that #AccountingOfficers rely on internal control systems.
IDAC is trying this #PFMA route just to test us and taint Gen Masemola's name!
