When the FDA says no, the media covers the FDA. The coverage is not about the regulation. The coverage is about the regulator.
A regulation can be debated on the merits. A regulator can be destroyed on character.

@Christina4HD Totally agree. But when they say yes, no one comes after them. They don’t need protection to say yes they can just say it and everyone claps. And I imagine it feels good to them to do so. The problem emerges when Pharma shows up with drugs that don’t meet standards.

@HCLibertyLab I understand your point, but saying “yes” can be just as courageous. Approving innovative treatments allows patients with serious or rare diseases to access potentially life‑saving therapies sooner. Each timely “yes” can prevent suffering, and in some cases, save lives.

That’s very true. But my point is when they say yes, there is zero pushback. It’s only saying no that requires bravery. Similar to the way the first amendment also protects my right to praise the government, but it doesn’t actually matter in cases of speech the government likes - it only comes in to play when they’re mad about it.

@HCLibertyLab Respectfully, regulators aren’t here simply to say “no” to pharma. They’re here to weigh risks & benefits based on the disease, the therapy & the unmet need. Their responsibility is to help ensure safe, effective, & innovative treatments reach patients as efficiently as possible.

ACIP has been disbanded.
The government’s response to the AAP lawsuit and judge Murphey’s injunction is to disband and then recreate a new ACIP committee, as this will take less time than would be required to file and prosecute an appeal. There will be no action from the government to respond to the defamatory characterization of the former ACIP members.
