Wow. Ciaramella used the old form, the one that did not allow hearsay. That means the entire impeachment was void ab initio, meaning it was legally dead on arrival. The fact that Atkinson then secretly changed the form and backdated it makes it all exponentially worse.

Back in 2019, we knew that Atkinson had changed the form, but we didn't KNOW whether Ciaramella had used the new form or the old form. It turns out that he had used the old form - the form which required first hand knowledge. The copy of Ciaramella form made public excluded the first two instruction pages in which the firsthand requirement was stated. While Atkinson subsequently changed the form, it was the earlier form that was submitted (sans the two instruction pages.) Atkinson's position was that Ciaramella had first hand knowledge of some things. However, the things that he had first hand knowledge of do not appear to have been especially relevant. Atkinson cited Grassley as authority that secondhand information should be permitted for a whistleblower report. But Atkinson glossed over difference between a non-urgent concern and an urgent concern. This doesn't seem to have been focussed on in discussion. The requirement for firsthand knowledge was reasonable enough for an "urgent" concern. Another point that hasn't been discussed much. In the Solomon articles in March-April 2019 which led into these discussions, there was discussion of Ukrainian interference in the 2016 election. Trump's contiguous discussion of the CrowdStrike server supports the possibility that Trump was seeking investigation of 2016 election interference - an entirely proper request - as opposed to anticipatory interference in the 2020 election. One of the major misunderstandings of Ukrainian interference in the 2016 is that the interference was initiated by Biden cadres (especially at the Jan 2016 meeting with Ukrainiain prosecutors and Biden cadres while Biden was a leading candidate for nomination) and resulted in the Black Ledger operation that decapitated Paul Manafort as campaign chair in August 2016. The role of Biden cadres in this interference has been clouded by incorrect pointing at Clinton campaign. There was obviously no way that any of Ciaramella, Wilde or Atkinson could have reasonably been sure that the issues raised by Trump weren't related to past 2016 events, as opposed to still distant 2020 events where Biden's nomination was far from guaranteed. The issue of Ukrainian interference in the 2016 election surfaced from time to time in the 2019 impeachment hearings, but was ridiculed and shouted down by State Department officials. None of the Republicans or their staff appear to have been well enough informed to focus on the valid issues.

FIFA have responded to this - and strongly. “We are quite surprised by the NJ Governor’s approach today on fan transportation. The original FIFA World Cup 2026 Host City Agreements signed in 2018 required free transportation for fans to all matches. Recognizing the financial strain this placed on the host cities, back in 2023 FIFA adjusted the Host Agreement requirements across all host cities as follows: All Match Ticket holders and accredited individuals shall be able to access transport (public or additionally planned transport) at cost to allow travel to Stadiums on match days.   “FIFA worked for years with host cities on transportation and mobility plans, including advocating for millions of dollars in federal funding to support host cities for transportation.   “FIFA World Cup will bring millions of fans to North America along with related economic impact. Many fans will travel to NYNJ to enjoy the eight matches scheduled. FIFA is not aware of any other major event previously held at NYNJ Stadium, including other major sports, global concert tours, etc., where organizers were required to pay for fan transportation.”

We inherited an agreement where FIFA is providing $0 for transportation to the World Cup. And while NJ TRANSIT is stuck with a $48 million bill to safely get fans to and from games, FIFA is making $11 billion. I’m not going to stick New Jersey commuters with that tab for years to come. FIFA should pay for the rides. But if they don’t – I’m not going to let New Jersey get taken for one.

Hacks like @stephen_richer are part of the continuing problem and truly understanding what happened on J6. He absolutely misrepresents the information that came out during trial. The very first government witness, SA Palian, conceded on cross-examination that the QRS’s were never intended for offensive purposes and were created as a defensive extraction mechanism only. As a matter of fact, the person in charge of the QRF’s were two 60+-year-olds, one of which that had to walk with a cane. The government largely abandoned this line of argument from early on in the trial. This pathetic hack also misrepresents that the oath keepers were discussing “overthrowing“ the government and their internal communications. That is not at all what they were discussing. I would be happy to sit down with Stephen and show him from the evidence that I actually possessed from trial that he is 100% wrong. Were there discussions regarding the 2020 election being fraudulent and asking for Trump to invoke the insurrection act as to investigate it? Absolutely. There was never a call to overthrow the government, and there was never a call at any point ever to intentionally interfere with the electors and the job that they were doing. People like this gentleman are going to historically be part of the problem of honest reflection on the actual events of that day.

Here's what I think might have happened with #TPUSA in Georgia. 1) Turnout to these events is collapsing ... the magic is gone ... the kids hate Israel and are beginning to hate Trump ... they already hated Vance. 2) Erika decides that she does not want to speak to dwindling crowds ... and that she might want to rescind her promise to help get JD elected. 3) Erika leaves JD high and dry, giving him yet another L. Organizations like TPUSA are baed on enthusiasm, vibes, and trajectory. They can collapse rather quickly.

I was reluctant to get involved in a one-on-one with Frei because it will be a non-stop session of me pointing out errors in the premises of his questions. For those who do not know, I rep'd Steven in his J6 case. We got to know each other before that while he was covering the Oath Keeper trials. We've shared info on his reporting -- but I treat those conversations as privilege. THAT is why I'm judicious in where I weigh in on the pipe-bomber case. I have a lot of respect for Steve and Joe Hanneman -- who I also know. They have spent a lot more time looking at it from all angles than I ever will -- frankly it is the one J6 subject that never drew a significant amount of my time or attention. I'm not convinced Steve is right, nor am I convinced the DOJ is right -- I just don't have enough independent evaluation of the evidence -- i.e., my own -- to come to a conclusion one way or the other. If we want to do this as a 3-way show with Steve joining us, I'd be happy to do it. What I don't want it to become, however, is a debate about the accuracy of the reporting by Steve and Joe. I won't do that and that's why I didn't respond to the invitation last night. Frei has aligned himself with a few folks I have no respect for at all. BUT, I find Frei's work on his own to be entertaining and engaging even if I disagree with things he says often. I won't waste my time with some of his companions. Steve knows from first hand experience that I disagree with my friends as much as my foes. I'm not shy about sharing my opinions, and Steve and I didn't always agree on all J6 matters. There is no reason Frei and I -- along with Steve -- couldn't create and entertaining and engaging product with a bit of prep and some agreements on what we are going to discuss and what we all agree to avoid. Let me know.
