The numbers in Jamelle Bouie’s piece are the argument. In 1975, there were 17 Black members of the House. In 1985, after two decades of the Voting Rights Act, there were still only 20. Then in 1982, Congress amended the VRA to address disparate impact in voting outcomes. In 1986, a unanimous Supreme Court held that the act forbade electoral schemes that impaired minority groups’ ability to elect candidates of their choice. States used the 1990 census and redistricting to create majority-minority districts. By 1995, there were 43 Black Americans serving as voting members of Congress - more than double the number from a decade earlier. That jump from 20 to 43 is what the 1982 amendment and majority-minority districting produced. Ari Berman projects the Callais ruling could cost a third of the Congressional Black Caucus. The CBC currently has 58 members. A third is roughly 19 seats. That would take Black representation in Congress back toward the 1985 baseline - before the redistricting that produced the modern era of Black political representation. The 14th and 15th Amendments were written and ratified specifically to ensure Black Americans’ participation in the political community after slavery. As Bouie notes, it is a perverse outcome that the Roberts Court is now using both amendments to achieve what could be the largest reduction in Black representation since the end of Reconstruction.

The RBG cult is too psychologically interesting, I waste three minutes thinking about it whenever the topic comes up. What’s the most popular message on RBG merch? Typically it’s “I dissent.” The stans aren’t venerating her opinion in United States vs. Virginia or Evenwel v. Abbott. She’s the icon of being smart and right while losing. This has transferred over to KBJ fandom; she never wins, but look at her epic roast in this dissent. It’s a cult of never holding power but being smug that the people holding power are wrong and maybe the biopic in 20 years will say so.
