The Bloomberg US Leveraged Loan Index has seen average secondary prices fall 10 out of the last 12 sessions and while earnings have looked good, bifurcation has been punitive for an increasing segment of the leveraged universe, leaving the amount of sub-$60 loans at their post-pandemic high. The consequences of the left tail have been on full display – notably in the software space – as the market has begun to treat many of the issuers as they would triple-C issuers.

I don't live in the Hamptons. My community is filled with low income service workers who farm the land, cut hair, mow the lawns, cook and serve the food. A few are almost certainly illegal most of whom have been here for decades and I am blessed with their service and love of our country. Yes I would welcome another bus load. My private property is not the question but I am happy to pay taxes to educate their kids and subsidize their affordable housing which can be next door if needed but it's not. and vote to do so.

Genuine question… What is the downside of returning illegal immigrants to their country of origin? The cost of a flight home seems considerably lower than years of housing and benefits. What am I missing?

I think it's that illegal immigrants are people. People who are likely to be at the lowest rung of society with horrible choices at home and in their foreign land they came to illegally. They present a rich country with a problem. It's true that most/all of the voter population would like them to have NOT come into the country illegally but they have done. Now it's a matter of compassion. Some (me) think keeping them here is the humane compassionate thing to do that makes our country great. Close the borders and don't let them in AND be compassionate with those who are here

The scenes this evening in Portswood are completely unacceptable. The Nowak family made a powerful call to us all yesterday to not let Henry’s death be used to create further division, hatred or tension. There can be no justification for hijacking this tragedy to stir up violence and disorder. Those responsible can expect to face the full force of the law. I thank the police who have tonight shown great bravery and calm in the face of disgraceful violence directed at them.

Judge Swain denies the bondholder's request to lift the stay in the 9th year of the Prepa bankruptcy #muniland. "The court already lifted the stay for the accounting counterclaim. This will provide the vehicle in valuing netrevs on a materially developed record. The power to stay is incidental to the courts power to control the docket. Federal courts have the power to stay proceedings for prudential reasons [cite, cite, cite]. As the court stated in March 13 and 16 orders prosecution of accounting counterclaim should lead to a formula to determine if netrevs exist. And lead to a plan confirmation proceeding and if bondholders are adequately protected. Bondholders argue timing requirements under 362 require the court to act promptly but the 1st Circuit held that bondholders waived that right but not seeking relief. In respect to renewed lift stay motion bondholders failed to comply with the courts procedures. The court has an ongoing right to control the proceedings. Given the potential of the resolution of the accounting counterclaim to progress to the plan of adjustment. Wants them to follow Judge Dein's discovery schedule and is encouraged by the mediation team's most recent report. I've been saying for 9 years that failure is not as option." Thanks the court staff. Hearing adjourned.

@MonitorHive I think Judge Dein is pretty fair to both sides. Bondholders likely loaded up their discovery requests with issues they knew they would lose on (the upfront ones) so they could win on the last and most important issues. That strategy worked.

Judge Dein will hold a discovery hearing in the Puerto Rico electric utility bankruptcy tomorrow re bondholders accounting claim (ie what happened to net revenues over the last 9 years - these revenues are bondholder collateral) #muniland. Prepa bondholders have argued for significantly more access to information to validate their claim that their collateral has been used for years (by Luma/Quanta etc) to fund projects that should have been funded with federal recovery funds. Bondholders want access to relatively granular data which makes sense since the utility is years behind in completing their required financials (left below). The OBoard has done nothing to help or expedite Prepa's financials. The Prepa bankruptcy has cost over $500 million so far (not including creditor lawyer/consultant fees) and it's unbelievable that 9 years into a bankruptcy there are no current financials. The OBoard insists that there have been no revenues but object to bondholders receiving enough data to run the numbers themselves and object to bondholders taking depositions from any party that has direct knowledge of how Prepa's accounting has been done over the years. Note over the last 10 years there have been ~$40 billion in revenues & the OBoard asserts that there were zero net revenues (netrevs exclude capex & certain other expenses).
