Το διεθνές δίκαιο και η Γάζα Το δίκαιο του πολέμου ορίζεται κυρίως από τις Συνθήκες της Γενεύης του 1949. Το 1998 συστάθηκε από τον ΟΗΕ το Διεθνές Ποινικό Δικαστήριο της Χάγης για να δικάζει τα εγκλήματα πολέμου. Το Ισραήλ ήταν μεταξύ των κρατών που καταψήφισαν τη σύσταση του, με κύρια αντίρρησή την συμπερίληψη στα εγκλήματα πολέμου της αναγκαστικής μεταφοράς πληθυσμού στα κατεχόμενα εδάφη. Το 2021 το Δικαστήριο αποφάσισε ότι έχει δικαιοδοσία στην Παλαιστίνη, τη Γάζα και τη Δυτική Οχθη, συμπεριλαμβανομένης της 
Ανατολικής Ιερουσαλήμ. Στο πλαίσιο της έρευνας το μεν Ισραήλ κατηγορείται για την ίδρυση παράνομων οικισμών και για παραβίαση του δικαίου του πολέμου κατά τις επιχειρήσεις στη Γάζα το 2014. Οι ένοπλες παλαιστινιακές οργανώσεις, μεταξύ των οποίων η Χαμάς, κατηγορούνται για επιθέσεις εναντίον αμάχων και για τη χρήση Παλαιστινίων ως ανθρώπινες ασπίδες. Σύμφωνα με πρόσφατες δηλώσεις του γενικού εισαγγελέα, και τα εγκλήματα κατά την διάρκεια του τωρινού πολέμου εμπίπτουν στη δικαιοδοσία της έρευνας αυτής. 
Ο πρωθυπουργός του Ισραήλ Μπ. Νετανιάχου αντέδρασε στην διεξαγωγή της έρευνας κατηγορώντας το Δικαστήριο για «καθαρό αντισημιτισμό». Προφανώς δεν είναι έτσι. Η εφαρμογή δικαίου που έχει την αποδοχή της συντριπτικής πλειονότητας της παγκόσμιας κοινότητας επ’ουδενί δεν μπορεί να θεωρηθεί αντισημιτική πράξη. Η διεθνής νομιμότητα, οι στοιχειώδεις κανόνες της ηθικής και η κοινή λογική υπαγορεύουν τα ίδια: 
καμία διαφορά δεν υπάρχει ανάμεσα σε ένα νεκρό παιδί από την Παλαιστίνη και ένα νεκρό παιδί από το Ισραήλ. 
Οι τρομοκρατικές επιθέσεις της Χαμάς κατά αμάχων ασφαλώς συνιστούν παραβίαση του διεθνούς δικαίου. Το ίδιο όμως συμβαίνει και για τις επιθέσεις κατά αμάχων από το Ισραήλ, το οποίο επιπλέον βαρύνεται από τις υποχρεώσεις του ως κατοχική 
δύναμη. Πέραν της γενικής πρόβλεψης του δικαίου του πολέμου για διάκριση μεταξύ 
μαχητών και αμάχων, δεσμεύεται από συγκεκριμένα άρθρα της Τέταρτης Συνθήκης της 
Γενεύης: Το άρθρο 14 για τα νοσοκομεία, το 49 για την απαγόρευση αναγκαστικής μεταφοράς πληθυσμού, το 53 για την απαγόρευση καταστροφής της περιουσίας, το 55 για την υποχρέωση παροχής τροφίμων, νερού και φαρμάκων, το 59 για την διευκόλυνση παροχής ανθρωπιστικής βοήθειας μέσω ελεύθερων διαδρόμων. Το άρθρο 33 απαγορεύει απολύτως τη συλλογική ευθύνη.

International Law, which includes the prohibition to use force to settle international disputes, is an integral, binding part of the EU Treaties. Its "expiration" cannot be decreed by anyone in a speech. Each EU institution should work in accordance to its respective competence.

I condemn today’s military escalation in the Middle East. The use of force by the United States & Israel against Iran, and the subsequent retaliation by Iran across the region, undermine international peace & security.   All Member States must respect their obligations under international law, including the Charter of the @UN. The Charter clearly prohibits “the threat of the use of force against the territorial integrity or political independence of any state, or in any other manner inconsistent with the Purposes of the United Nations.”   I call for an immediate cessation of hostilities & de-escalation. Failing to do so risks a wider regional conflict with grave consequences for civilians & regional stability. I strongly encourage all parties to return immediately to the negotiating table.   I reiterate that there is no viable alternative to the peaceful settlement of international disputes, in full accordance with international law, including the UN Charter. The Charter provides the foundation for the maintenance of international peace and security.

I strongly condemn the Israeli & US aggression against Iran, in violation of the most fundamental rule of international law - the ban on the use of force. All responsible governments should condemn this lawlessness from two countries who excel in shredding the international order

Human rights are under full-scale attack around the world. It's happening in plain sight & often led by those with the greatest power. But human rights are not a slogan for good times. They are a duty at all times. We must stand up for them even when it is difficult & costly. Especially then.
