In 1986, Congress eliminated the right to sue pharmaceutical companies for vaccine injuries. In exchange, injured individuals were promised fair and speedy compensation through the Vaccine Injury Compensation Program. They gave up their right to sue the manufacturer, their right to full damages, and their right to discovery. Pain and suffering is capped at $250,000. So is death. The mechanism created to deliver that promised compensation was the vaccine injury table, a list of injuries associated with each covered vaccine. When an injury is on the table, the burden shifts to the government to prove the vaccine didn't cause it, rather than requiring the injured person to prove that it did. The table has not been updated since 2017.
