Tana Adkin KC The CBA would like to express its admiration and sincere thanks for the tireless work undertaken by Tana over many years on behalf of us all and especially for her work as Vice Chair and Chair over the last two years. Tana has been a huge supporter of the criminal bar, was instrumental in negotiating with the MOJ and has been determined to continue to try to hold the MOJ to account to ensure that the entirety of the agreement is honoured.  She stood on the steps of many Crown Courts during the action to support us all. Tana is courageous and determined. She has given us her everything. Throughout her term Tana continued to prosecute and defend across the country. Tana can now focus entirely on her career, but in her usual selfless way, has offered to develop a new project for the CBA in the New Year.

…so the moral of today’s story: If you sing with your arms in the air & your team playing M Utd, be careful as a police officer might accuse you of public order offence Well done to James Bull @15nbs who secured an acquittal after a trial today 👏👏👏

Chair Tana Adkin KC message “We recommend a full read of the Independent Review by our former chair of the CBA, Chris Henley KC of the @ccrcupdate handling of the #AndrewMalkinson case” These are CHKC’s final remarks “There needs to be a culture within our Criminal Justice System where it is acknowledged that mistakes can be made and in our various roles when making decisions we are all alive to this potential risk.  If we are vigilant in this way it will make miscarriages of justice less likely to happen.  When mistakes are made the victims of miscarriages need a robust, appropriately resourced, bold, mission driven organisation fearlessly asking the right questions and analyzing new evidence and submissions rigorously and above all correctly identifying the cases that should be referred.  This is what the CCRC must always aspire to be.” Chair Tana Adkin KC adds “We must all recognise that within a Criminal Justice System under-resourced and under pressure we will from time to time make mistakes, none of us are perfect.  We rely on the court, appeal courts and organisations like the CCRC as vital safety nets to ensure that even if we make a mistake the system will prevent a miscarriage of justice.”   The concluding remarks are from paragraph 132 on page 101 onwards and the nine recommendations can be found at page 109 to 114.  It is noteworthy that Chris Henley KC’s ninth recommendation was that the CCRC be provided with more resources by Government.” …967ba1215eaecede923f.s3.amazonaws.com/uploads/sites/…

Tana Adkin KC, chair of the Criminal Bar Association, blamed a Ministry of Justice “failure” to ensure every case had available counsel, a judge, a jury and a working courtroom. @Independent “The NAO report confirms that which criminal practitioners have known for years – that the criminal justice system remains in crisis without a plan for sustained investment, despite the repeated warnings of prosecutors and defence advocates,” she said. independent.co.uk/news/uk/home-n…

The National Audit Office @NAOorguksays report highlights how logjams in the system affect justice, the watchdog says delays are also risking cases collapsing because victims and witnesses may withdraw, and their memories of evidence decline over time. @Independent independent.co.uk/news/uk/home-n… A government target of cutting the backlog of crown court cases, set three years ago, is no longer achievable, the UK’s spending watchdog has said, after the number of cases waiting to be heard hit record levels. National Audit Office (NAO) says that instead of falling, caseloads are 78 per cent higher than at the end of 2019, and 11 per cent up on June 2021, when the spending watchdog last investigated, and the target cannot now be reached. In October 2021, the department launched a plan to reduce the backlog, which now stands at 67,573, to 53,000 by March next year. That would mean a reduction of more than a fifth. Cases waiting to be heard hit record levels instead of falling, with most taking nearly two years to go ahead At least a quarter of cases (27 per cent) have waited for a year or more to be heard, prolonging distress to victims, witnesses and defendants, according to NAO figures. Severe jail overcrowding is one of the biggest obstacles to reducing the delays, but leaking buildings and heating failures are also to blame independent.co.uk/news/uk/home-n…
