✍ 𝗡𝗲𝘄 𝗮𝗿𝘁𝗶𝗰𝗹𝗲 𝗼𝗻 𝗱𝗲𝗳𝗮𝗺𝗮𝘁𝗶𝗼𝗻 𝗹𝗮𝘄 𝗶𝗻 𝗚𝗶𝗯𝗿𝗮𝗹𝘁𝗮𝗿 In a newly co-authored article, Julian Santos of 𝟱𝗥𝗕 and Nicholas Borge, Director of Ramparts, take a closer look at Gibraltar's unique defamation regime. The piece is an introduction to defamation law in Gibraltar, spotlighting key differences from the law of England & Wales, particularly in the light of the Defamation Act 2013, such as: the absence of the "serious harm" test, a six-year limitation period, and the continuing right to a jury trial in defamation cases. Judgment has been handed down by Mr Justice Johnson in favour of the Defendants in 𝑀𝑜ℎ𝑎𝑚𝑚𝑒𝑑 𝐻𝑒𝑔𝑎𝑏 𝑣 (1) 𝑇ℎ𝑒 𝑆𝑝𝑒𝑐𝑡𝑎𝑡𝑜𝑟 (2) 𝐷𝑜𝑢𝑔𝑙𝑎𝑠 𝑀𝑢𝑟𝑟𝑎𝑦. The Claimant complained in libel and data protection of an article published in The Spectator in September 2022. At trial he failed to establish that serious harm had been caused to his reputation by the publication of the article. The Judge also found that the article was substantially true in its description of the Claimant, and so the Defendants’ defence of truth succeeded, and the claims were dismissed. William Bennett KC acted for Douglas Murray. Greg Callus, leading Hector Penny, acted for The Spectator. 5rb.com/news/mohammed-…
